Market · Medtech legal talent
The conformity seat most legal departments still do not staff.
A company selling a device or a digital-health product into Europe now needs one in-house lawyer who can hold the EU route, the UK path and the software classification on the same product. Most departments have a Quality team that owns the file and a general counsel who signs it.
Who actually buys the medical device regulatory seat.
A general counsel who needs a medical device lawyer in London is not short of Quality staff. Sartori maps roughly 30,000 lawyers in London; that file records admission and employer, not RAC-Devices or PRRC designation. In the same London interview cohort, 94 of 118 general counsel and heads of legal at device, diagnostics and digital-health companies, over a 24-month window, said regulatory affairs owns the conformity file and Legal signs it.
On the career pages of device and digital-health employers reviewed, Quality Assurance and Regulatory Affairs is listed as a corporate function distinct from Legal. The statutory seats that do exist — UK Responsible Person, the EU Person Responsible for Regulatory Compliance, a proposed UK Qualified Person that is not yet law — are not the same as an in-house device counsel. The title you are hiring is not on the org chart.
The buyer is a company. The question is who holds the conformity route. The stacked regimes are set out below.

Most legal departments already have the scientists. They still lack the lawyer.
The buyer's question is not whether medtech is hiring. It is whether the conformity route is a legal seat, a Quality seat, or an outside instruction — and why the requisition stays open after Quality is staffed.
Sartori has worked the London in-house market for more than 10 years, for device manufacturers, diagnostics companies, digital-health businesses and the health units of larger groups. Over the trailing three years the desk closed 24 in-house searches at a 93 percent completion rate, on a typical timeline of 4 to 7 months. Nine of those 24 were device, diagnostics or digital-health regulatory seats. The other 15 were commercial, corporate or generalist in-house mandates that happened to sit in the same sector. The nine are the subject of this page. That London book sits inside a global research programme that has mapped nearly 1.5 million lawyer profiles and has run quarterly market surveys since 2019.
The opening fact is organizational, not doctrinal. On the career pages of device and digital-health employers reviewed for this piece — including a long-standing wound-care and orthopaedics manufacturer and a London remote-monitoring company — Quality Assurance and Regulatory Affairs is listed as a function of its own. Legal is listed beside it, or folded into Corporate Functions. None of those pages advertised a title called “device regulatory counsel.” The credentialing infrastructure that does exist is scientific. RAPS, which connects about 30,000 professionals worldwide, issues RAC-Devices and MDR- and IVDR-specific compliance certifications. TOPRA, headquartered in London, registers MTOPRA holders as Chartered or Registered Scientists on a minimum of 50 continuing-professional-development hours a year, and co-runs postgraduate awards with the University of Hertfordshire. Those are Quality credentials. They are not a law degree and they are not a substitute for one.
That is the uncovered seat. A company selling a device or a digital-health product into Europe now needs one lawyer who can hold the conformity route under the EU medical-devices and in-vitro-diagnostics regimes, the post-Brexit UK registration path, software-as-a-medical-device classification, and the data and AI rules that sit on top of the same product. Most legal departments do not have that person. They have a regulatory-affairs team that owns the file and a generalist counsel who signs it. The general counsel still carries the UK Responsible Person liability, the Article 10a interruption notice, and the classification call when a software tool crosses the MHRA line. Signing is not holding.
Therapeutics hiring and collaboration-licensing hiring are adjacent and already owned elsewhere. A cell-and-gene regulatory seat is a different product, a different regulator conversation and a different candidate pool. A life-sciences licensing counsel is hired to paper a deal, not to keep a notified-body certificate alive. This page stays on devices, diagnostics and health software. The whole-specialism life-sciences hiring read is the sibling that owns the broader supply question; it is not repeated here.
Quality owns the fileA lawyer holds the route
- Regulatory affairs Technical file, clinical evaluation, portal, RAC-Devices fluency. This is the function companies already staff, and it is not a legal department.
- Generalist in-house counsel Commercial contracts, employment, the privacy notice, the signature block on the UK Responsible Person appointment. Necessary. Not sufficient.
- Device-regulatory counsel The scarce seat: one in-house lawyer who can hold EU conformity, the UK dual-track, software classification and the overlay rules on the same product.
The uncomfortable read from our own book is not that the seat is imaginary. It is that companies keep writing it as if the first two stops were one person. Of the nine device-regulatory mandates inside those 24 closed London in-house searches, four required a rewritten brief after first interviews because Legal and Quality could not agree the reporting line. Two of the nine were completed only after the company accepted a senior regulatory-affairs hire reporting to the chief legal officer rather than a qualified lawyer. The search did not produce a dual-skilled counsel inside the 4-to-7-month window. That is a finding against the easy story of the desk: we can close the mandate and still fail to put a lawyer in the chair the general counsel asked for.
Most legal departments do not have that person. They have a regulatory-affairs team that owns the file and a generalist counsel who signs it.
Four kinds of company, one missing lawyer.
The employer is a manufacturer, a diagnostics business, a digital-health company, or the health unit of a larger group. The buyer is the general counsel, the chief legal officer or the head of legal — not a hiring committee at a law firm.
Device manufacturer
Hardware on a CE or UKCA route, a UK Responsible Person contract if the factory sits outside Great Britain, and a notified-body slot that now takes most of a year. The general counsel signs. Quality lives in the portal.
Diagnostics company
IVDR since 26 May 2022, a later clock than devices, and a companion-diagnostic file that a counsel who only tracks MDR dates will miss. Northern Ireland still pulls in the EU Person Responsible for Regulatory Compliance.
Digital-health / SaMD company
Classification is the first legal question, not a privacy notice. MHRA's July 2026 ambient-voice line is the live example: intended use that supports diagnosis or places an order without clinician review is a device.
Health unit of a larger group
A corporate legal department that already has a generalist bench and a Quality function, and still cannot name who holds the conformity route when the same product crosses MDR, the UK dual-track and a software overlay.
Start with scale, because the buyer pool is larger than the legal-department headcount implies. MedTech Europe, in Facts & Figures 2025 published on 4 September 2025, put more than 38,000 medical-technology companies in Europe, 90 percent of them SMEs, employing more than 930,000 people and bringing more than 2,000,000 products to market. ABHI states that it represents 400 member organizations, and that about 80 percent of those members employ fewer than 250 staff. The Office for Life Sciences, in Bioscience and Health Technology Sector Statistics 2023 to 2024 published on 2 October 2025, put the UK medical-technology sub-sector at 4,360 companies, 196,000 people and £48.0 billion of turnover, and flagged the edition as official statistics in development after a methodology change. Regional shares of that official cut sit on the employment-and-turnover chart later on this page. This is a corporate market with a London legal-department problem, not a City law-firm problem.
Of the 118 general counsel and heads of legal in the London interview cohort who sat at a device, diagnostics or digital-health company over that 24-month window, 41 said they had tried to open a dedicated device-counsel seat in the prior 18 months. Twenty-seven of those 41 said the requisition was still open or had been withdrawn. The stall was not a missing shortlist. It was a missing decision about whether the seat reported to the general counsel, to the vice-president of Quality, or to both, and whether the person had to be a solicitor at all.
A chief legal officer at a private-equity-backed UK diagnostics manufacturer put it without decoration: the notified-body clock, not the legal market, was why the requisition stayed open, and the department already had a Quality director who lived in the portal. A head of legal at a London digital-health company said the MHRA line on ambient voice was the first time anyone had asked Legal to classify the product rather than just the privacy notice. Both descriptions match the career-page split. Both are why a generalist in-house hire does not close the file.
Eighty-six of those 118 respondents sat at a company that had appointed a UK Responsible Person. Sixty-one of those 86 said Legal signed the designation contract and Quality ran the MHRA registration. gov.uk is explicit that registration “does not represent any form of accreditation, certification, approval or endorsement,” and that a non-UK manufacturer must appoint a single UK-based Responsible Person who takes on manufacturer obligations under a formal designation contract. The 2022 consultation outcome on economic operators, updated 26 June 2022, said 71 percent of respondents backed a physically UK-located Responsible Person and that the person should be legally liable for defective devices on the same basis as the manufacturer. Liability sits in Legal. The file sits in Quality. That is the buyer's gap.
| Model | When it holds | Where it breaks | Who is actually hiring |
|---|---|---|---|
| Quality owns, Legal signs | A single mature hardware line, one notified body, no software overlay | Dual-track GB/EU sales, SaMD classification, Art. 10a supply notices, UK Responsible Person liability | A generalist in-house counsel already on the payroll |
| Dedicated in-house device counsel | A standing product factory selling into the EU and Great Britain, with software or diagnostics in the stack | When the brief still describes a RAC-Devices scientist and a commercial lawyer as one person | The general counsel or chief legal officer, with a dotted line into Quality |
| Standing outside instruction | A one-off first CE certificate or a single UK Responsible Person contract | A target that moved in 2023, 2024, 2025 and was reopened by industry in 2026 | The head of legal buying a panel, not a seat |
A hardware or diagnostics general counsel is buying notified-body capacity and a dual-track GB/EU file, not a software classification argument.
BVMed's Branchenbericht, drawing on the 2025 autumn survey and 2024 GGR figures, put German medtech at 212,100 direct employees, more than €55 billion of turnover including micro-enterprises, and 1,508 to 1,510 manufacturers with 20 or more staff. That is the Munich-adjacent industrial bench a London general counsel meets when a German group opens Great Britain sales — a landscape fact, not a second Sartori book. ABHI and CPI, citing the same OLS 2023/24 release, counted 1,386 UK HealthTech companies with manufacturing as their core activity, £20.9 billion of turnover and more than 83,000 people. Oxford Nanopore's careers page notes that some of its diagnostics products may be regulated as in-vitro diagnostic devices depending on jurisdiction, beside research-use-only lines. A mixed portfolio is exactly the brief that a single Quality lead and a single commercial counsel cannot split cleanly.
A digital-health chief legal officer is buying a classification call that can turn a software tool into a regulated device overnight.
Rock Health, in its 12 January 2026 year-end review, recorded $14.2 billion of US digital-health funding in 2025 across 482 deals, up 35 percent from $10.5 billion in 2024, with AI-enabled companies taking 50 percent of deals and 54 percent of dollars. Its Q1 2026 review recorded $4 billion across 110 deals. HTN reported on 29 July 2026 that the MHRA had drawn the ambient-voice line: a tool that supports diagnosis, treatment or prevention, or that places orders without clinician review, is a device; pure transcription reviewed by a clinician is not. NHS England's ambient-voice registry listed 19 qualifying suppliers as of that article. Digital Health and Care Wales opened a £10 million ambient-voice framework on 2 September 2026. North West London and South West London Pathology announced a joint £28 million pathology IT and LIMS procurement the next day. Capital is not waiting for the legal department to finish its org chart.
One product, four clocks, and a fifth if the software thinks.
The perimeter of this in-house seat is the stack. A counsel who holds only MDR, or only UKCA, or only a privacy notice, is a partial hire.
EU MDR — Regulation (EU) 2017/745 — has applied since 26 May 2021. EU IVDR — Regulation (EU) 2017/746 — has applied since 26 May 2022. Those dates, from the European Commission's medical-devices sector pages, are the floor of the seat, not the reason a general counsel opens a requisition in 2026. The reason is that the floor kept moving. Regulation (EU) 2023/607, adopted 15 March 2023, extended the MDR Article 120 legacy-certificate periods toward 2027 and 2028 by class and removed the May 2026 sell-off cut-off. Regulation (EU) 2024/1860, published 9 July 2024, added a manufacturer and notified-body duty to notify anticipated interruptions or discontinuations of supply. That second amendment is a legal-judgment trigger. When a supply risk becomes a notifiable “anticipated interruption” is not a portal field. It is a call the chief legal officer has to be able to defend.
The UK ran a parallel, still-unfinished reform. UKCA marking became the Great Britain route from 1 January 2021; gov.uk guidance updated on 20 February 2026 still extends CE recognition to 30 June 2028 for old MDD and AIMDD certificates and to 30 June 2030 for IVDD-era diagnostics and for devices already certified under MDR or IVDR. The Medical Devices (Post-market Surveillance Requirements) (Amendment) Regulations 2024 — SI 2024/1368 — put a new Part 4A into the 2002 Regulations from 16 June 2025. UK Responsible Person accounts required an update by 30 March 2026 or faced closure. The 2021-2022 MHRA and DHSC consultation drew 891 responses and closed its outcome on 26 June 2022; the core post-Brexit framework it promised is still a patchwork of UKCA, extended CE recognition and amending statutory instruments. The proposed UK Qualified Person in that outcome is not enacted law, and the draft itself said an SME need only have the person permanently at its disposal — a bought-in resource, not necessarily an employee. Do not hire against a proposed seat as if it were already on the statute book.
| Regime | Live since | Legal judgment | What Quality still files |
|---|---|---|---|
| EU MDR / IVDR conformity | 2021 / 2022 | Which class, which notified body, when a supply risk becomes a notifiable interruption under Art. 10a | Technical file, clinical evaluation, portal submissions |
| GB UKCA plus extended CE recognition | 2021; CE to 2028 / 2030 | Whether the company can keep a CE certificate alive in Great Britain, and who is the UK Responsible Person | MHRA registration, post-market surveillance pack from 16 June 2025 |
| Northern Ireland / Windsor Framework | 2021 (MDR) / 2022 (IVDR) | A third UK sub-regime: CE plus UK(NI), an EU or NI authorised representative, and an Article 15 PRRC | Marking and representative appointment paperwork |
| SaMD and AI-enabled device classification | Guidance still being rewritten, 2025 | Whether intended use crosses into a regulated device; the high-risk AI Act call rides inside the same file from 2028 | Software lifecycle evidence, change-control, real-world performance |
| European Health Data Space overlay | In force 2025; duties phase to 2031 | Whether a digital-health product is also an EHR system with interoperability and security duties | Technical interoperability evidence |
Hardware conformityData and software overlays
- EU MDR / IVDR The floor since 2021 and 2022. Class, notified body, technical file, and now the Article 10a interruption notice.
- UK dual-track UKCA plus extended CE recognition, a UK Responsible Person, and a Northern Ireland file that still speaks EU.
- SaMD classification Intended use, not the marketing site. Guidance revised in 2025; the MHRA ambient-voice line is the applied example.
- Data and AI overlays EHDS duties on digital-health products; an AI-enabled device that already needs notified-body sign-off is high-risk under the AI Act from 2028.
An AI-enabled device or diagnostic that already needs notified-body sign-off under MDR or IVDR is high-risk under Article 6(1) of Regulation (EU) 2024/1689 from 2 August 2028; the counsel who signs the device file makes that call inside the same file. The obligation stack of the AI Act itself is a sibling page. Health-data duties may change this seat's perimeter — the European Health Data Space phases primary use from March 2029 and a second tranche of secondary-use data from March 2031 — without turning the hire into a privacy-market search. Boston sits in the same product conversation on a different mechanism: the FDA's Digital Health Center of Excellence has, in the 2024-2026 window, issued lifecycle and marketing-submission recommendations for AI-enabled device software, a predetermined change-control-plan concept that has no direct MDR or UK equivalent, and a TEMPO pilot. MassBio's August 2026 Industry Snapshot put Massachusetts biopharma employment at 113,503 jobs in 2025, a 3.1 percent decline, and Massachusetts-headquartered life-sciences companies at $3.45 billion of venture funding in the first half of 2026. Those figures are biopharma-wide, not device-specific. They are Boston context for a London general counsel whose product also sells in the United States, not a second hiring book.
Under 6 months
14% of new MDR certificates issued in 2025
Team-NB Medical Device Survey 2025When a supply risk becomes a notifiable anticipated interruption is not a portal field.
The target moves faster than a project instruction can follow.
Capacity at the notified body, dual-track recognition, a still-unfinished UK reform, and an industry campaign to reopen MDR and IVDR in 2026. None of those is a reason to wait. All of them are reasons the seat is standing headcount.
Team-NB's 2025 survey put IVDR at 3,076 cumulative applications and 2,104 certificates among its 41 members, and said certificate-issuance growth slowed in 2025 to two-thirds rather than the doubling seen in 2023 and 2024. Sixty-one percent of new IVDR certificates issued in 2025 took 13 to 18 months. The 41 members issued 17,260 certificates in total, a mean of 347 per body against a median of 68 — capacity is concentrated, not evenly spread. Team-NB estimated its members represented 81 percent of all MDR certificates issued industry-wide. MDCG 2022-14, published in August 2022, was the Commission's own acknowledgment of a notified-body capacity shortfall — the diagnosed problem the 2023 extension was built to answer. A signing bonus does not move a notified-body clock. A title does not create a certificate slot.
ABHI and CPI's 2025 survey is the UK industry voice on the same squeeze. More than half of respondents said UK regulatory capacity across conformity assessment, approved bodies and the MHRA had worsened. Two-thirds believed other countries were doing more to promote AI adoption in HealthTech, naming the United States most often and pointing to Germany's DiGA pathway and France's PECAN scheme as structural benchmarks the UK lacks. Those are buyer-side reasons a head of legal cannot treat Great Britain as a residual market the panel firm will tidy up later. The launch-delay, withdrawal and funding-confidence cuts from the same survey sit on the chart below.
In Sartori's 2026 first-half quarterly survey wave, 38 of 55 London in-house respondents in medtech named the Great Britain / EU dual route as the reason they would not return the conformity file to a single outside firm. That wave sits inside the same research programme; it is not a second interview count. Three of the nine device-regulatory mandates drew a counter-offer, in line with the 32 percent incidence on the London in-house line. Offers that did go out still signed on the same 13-working-day median as the rest of the book. The stall is before the offer, not after it. Seven of the nine ran past five months, which is still inside the 4-to-7-month band and tells you where inside that band this seat lives.
BSI describes itself as holding dual designation — an EU notified body and a UK approved body — for device conformity assessment. Even the certification infrastructure had to become dual-hatted after Brexit. The MHRA's Software and AI as a Medical Device Change Programme page was published on 16 September 2021 and last substantively updated on 14 June 2023, more than three years before this article, while the Agency continues to issue narrower classification lines elsewhere. A head of legal who staffs against a single stale roadmap will miss the live line. That is a coverage limit on the public side. Sartori's London mapping has one of its own: it records admission and employer. It does not record RAC-Devices, PRRC or UK Responsible Person designation, because no public register of those credentials sits on a lawyer file. We can see the legal population. We cannot see, from the map alone, who can actually hold this seat.
Write a perimeter, not a scientist-plus-lawyer chimera.
The general counsel who fills this seat decides reporting line, statutory designations and the classification call before a shortlist is opened. The companies that skip that conversation reopen the requisition.
Two anonymized composites from the London in-house book show the difference between a brief that names the perimeter and a brief that hopes the same person is a RAC-Devices scientist and a solicitor.
A private-equity-backed UK diagnostics manufacturer asked for an in-house counsel who could hold an IVDR technical file, a UK Responsible Person contract and a Northern Ireland PRRC appointment while the Quality director kept the notified-body portal. The first draft of the brief described a regulatory-affairs manager with “legal experience.” First interviews failed. The rewritten brief put the seat in Legal, reporting to the chief legal officer, with a dotted line to Quality. The search closed in six months. The offer signed in 13 working days. The complication was not the candidate pool. It was the company's refusal, for the first eight weeks, to say which function owned the interruption-notice call under Article 10a.
A London digital-health company opened a seat after the MHRA's 29 July 2026 ambient-voice guidance made clear that a documentation tool placing orders without clinician review was a regulated device. The head of legal had a two-person commercial team and a Quality and Regulatory function. Nobody on either side would sign the intended-use statement. The brief that worked named classification, UKCA or CE route selection, and the UK Responsible Person designation as Legal work, and left the software-lifecycle file in Quality. The search closed in five months. A counter-offer arrived from the candidate's current employer, in line with the 32 percent London in-house rate, and did not move the acceptance window past 13 working days.
A third composite sat on the Munich-to-London axis without becoming a second book. A mid-size German hardware manufacturer opening Great Britain sales needed one London in-house lawyer who could hold UKCA, extended CE recognition and the UK Responsible Person contract while the German Quality function kept the EU notified-body relationship. BSI's dual designation is the certification counterpart; the legal seat still had to sit in London because the Responsible Person has to. The search ran to seven months, the top of the London in-house band, because the first shortlist was built from commercial counsel who had never read a designation contract.
Price the seat on that perimeter. The general in-house compensation table is the published band this page will not rewrite. ABHI's 2025 survey said regulatory, compliance and quality-assurance recruitment was driving pay in those functions above the national average of increase and did not publish a percentage. A chief legal officer who opens with a guessed device-counsel figure is not briefing a search. They are briefing an argument with Finance. Decide reporting line, decide who holds the statutory designations, decide whether software classification lives in Legal, and then run an in-house search against that matrix. Adjacent compliance leadership, where the company also needs a named officer in front of the MHRA, sits on the compliance and regulatory desk.
- Q1 Does the company sell a device, a diagnostic or a health-software product into the EU and Great Britain on a live dual-track? If the product is therapeutics, a collaboration, or a pure privacy file → this is the wrong requisition.
- Q2 Can the general counsel name who holds classification, the UK Responsible Person liability, and the Article 10a interruption call? If the answer is “Quality, and Legal signs” → you are describing the gap, not a staffing plan.
- Q3 Is the need standing — a moving target through 2028 and 2030 — or a single certificate? If it is a single first certificate → buy a standing outside instruction. If the target is still moving in 2026 → hire the seat.
- → All three clear? Write a perimeter and reporting line, then open a confidential in-house search. Do not advertise a scientist and a lawyer as one person.
Device-regulatory counsel: questions a general counsel actually asks
Who inside a company should hire medical device regulatory counsel?
The general counsel or chief legal officer: 9 of Sartori's 24 closed London in-house searches over three years were this seat. Quality can run the technical file. Legal has to hold the conformity route, the UK Responsible Person contract, and the classification call when software crosses into a regulated device.
Is the conformity file a legal seat or a regulatory-affairs seat?
Day to day it is a Quality file: 94 of 118 London device-company general counsel said Legal signs rather than drafts. That cut, over a 24-month window inside Sartori's London interview cohort, is why the requisition stays open. The company already has the scientists and still lacks the lawyer who can hold the stacked regimes.
What does the in-house device-regulatory perimeter actually cover?
Four live regimes sit on one product, starting with EU MDR on 26 May 2021. IVDR followed on 26 May 2022. The UK dual-track runs through 30 June 2028 and 30 June 2030. Software classification and European Health Data Space rules, in force 26 March 2025, sit on top. Cell-and-gene work and collaboration licensing sit on other desks. An AI-enabled device that already needs notified-body sign-off is high-risk under the EU AI Act from 2 August 2028; that liability stack is a sibling brief.
What does this seat pay in London?
No dated compensation band for this seat was sourceable in London, Munich or Boston from a permitted 2026 source. ABHI and CPI's 2025 Pulse of the Sector reported 45 percent of companies having difficulty recruiting regulatory-affairs, compliance and quality-assurance staff, and described pay in those functions as rising faster than the national average without publishing a premium. Price the search on scope and reporting line, not on an invented figure.
Why does the requisition stay open once Quality is staffed?
The compliance target has moved three times since 2021 and was still being reopened in 2026. MedTech Europe called for a targeted MDR/IVDR revision on 5 May 2026 and again, with six fellow associations, on 19 June 2026. A general counsel who hired against a finished rulebook in 2024 is already rewriting the brief.
How long does a London in-house search for this seat take?
Sartori's London in-house line fills typical seats in 4 to 7 months, at a 93 percent completion rate across 24 closed searches over three years. Device-regulatory mandates cluster at the long end of that band, because the first brief so often describes a scientist and a generalist in the same sentence.
Regulator texts, notified-body surveys and sector statistics.
Application dates and statutory instruments come from the Commission, MHRA and legislation.gov.uk. Capacity and issuance figures come from Team-NB. Sector scale comes from MedTech Europe, OLS and BVMed. Sentiment comes from ABHI and CPI. Sartori figures come from the London in-house research programme.

Team-NB volumes are cumulative member-survey counts to end-2025, not an EU-wide census of every designated body. OLS 2023/24 figures are official statistics in development and are not comparable to the prior series. MassBio 2026 figures are biopharma-wide, not device-specific. ABHI pay commentary is directional and carries no published premium. No dated compensation band for this seat was retrieved from a permitted source.

We map in-house device, diagnostics and digital-health regulatory counsel for companies selling into the EU and Great Britain. We are just as willing to say the brief still describes two jobs as to open a search. Confidential, no obligation.
