ACC/Empsight 2025 reports 1,632 U.S. respondents across mixed company sizes, with data effective 1 March 2025; the 2026 edition had no public figures on 30 September 2026. The 2024 ACC report named IP and patent litigation and licensing among the five practice areas with the highest median total cash for general counsel and chief legal officers, and printed no IP-counsel dollar. AIPLA publishes IP compensation only to members and is not quoted here.

Sartori has run 17 such searches since 2017; the 14 closed from 2023 to 2026 are the base for every row.

No public survey prints the number. The benchmark is the seat one level up, the seat one level down, and the estate the person is asked to own.
On the benchmark gap
03 Patents vs licensing

Patent-led and licensing-led seats are paid differently.

The title is the same. The mandate, and so the pay mix, is not.

A patent-led chief IP counsel owns prosecution strategy, the portfolio budget, freedom-to-operate opinions and the litigation posture. The job is defensive and structural: protect the estate, avoid the injunction, support the next financing or acquisition. Pay tracks the general counsel scale. ACC/Empsight 2025 reports $245,000 base for associate general counsel and $330,000 for general counsel and chief legal officer, and a patent-led head of IP sits between them and above the senior attorney median of $201,000 (data effective 1 March 2025). In our searches closed 2023-2026, patent-led seats paid a median base about 6% above licensing-led ones.

A licensing-led head of IP owns out-licensing, in-licensing, standards and royalty programs. The job is commercial. It reports into a general counsel, a chief business officer or a chief executive, and part of the package is tied to deal revenue. In our searches the licensing seats paid a lower base but a larger bonus share: 40%-80% in technology and 40%-75% in life sciences, against 35%-60% for patent-led technology seats, 2023-2026.

The 2024 ACC report names IP and patent litigation and licensing among the five practice areas whose general counsel earn the highest median total cash. That is the general counsel column, not the IP-counsel column. It explains why a company that runs its strategy through its patents tends to pay the IP leader closer to the general counsel than a company that treats IP as a support function.

04 Technology vs life sciences

A patent estate is worth more to a drug maker than to a software group.

The premium sits where the patent is the asset the valuation rests on.

In life sciences, one patent family can carry a product line. The chief IP counsel is judged on Hatch-Waxman and biologics exclusivity, orange-book listings, term extensions and partnering deals. Technology seats manage a large, fast-moving portfolio with a heavy defensive component: non-practicing entity claims, open-source exposure, standards commitments. In our searches closed 2023-2026, life sciences seats (n=5) closed at a median base 9% above technology seats (n=6), at $400,000-$540,000 versus $360,000-$480,000 for patent-led technology seats.

Technology pays back in equity. At growth-stage technology companies, the equity grant was the larger line in the offer. At listed life sciences companies, cash and annual performance shares were the larger lines. Read the letter against the company's stage, not the industry average.

Read the offer from your side.

The same number looks different to the person paid and the company paying.

Your comparison is not the law-firm scale. It is the seat one level up and the estate you will own.

What to testWhy it matters
Does the title report to the general counsel or the CEO?ACC/Empsight 2025 pays general counsel $330,000 base; a direct CEO line lifts the band
Do you own licensing revenue? The bonus share can exceed the patent-led seat, with a lower base
What is the equity worth, and when does it vest?Technology seats pay back in equity; value depends on stage and liquidity
Is outside-counsel budget yours?A controlled panel budget is the clearest signal of a true head-of-function seat
Do you leave a firm lockstep?Milbank's eighth-year base is $455,000 from 1 July 2026; the in-house offer is cash plus equity, not a match

Price the seat against the general counsel cell, then adjust for the estate and the remit. Do not open at the firm scale.

The hiring clock is the second cost. Sartori's median for a general counsel or chief legal officer search is 24 days to shortlist and 11 weeks to an accepted offer, across 52 GC and CLO placements since 2017. Chief IP searches closed 2023-2026 ran a median of 12 weeks to an accepted offer (n=14). The pool of lawyers who have run prosecution and a licensing program is small, and most are not looking.

Fees are retained only: 25-30% of the hire's first-year total compensation, with a retainer of 30% of the fee, and a 12-month replacement guarantee on general counsel, chief legal officer and chief compliance officer searches.

06 For the company

Hiring a chief IP counsel: where the offer is won or lost.

Three mistakes show up in closed searches.

01

Anchoring to the firm scale

A firm lockstep is a billing scale. Matching a $455,000 associate base (Milbank, 1 July 2026) in cash misses that the in-house offer is cash plus equity plus scope.

02

Benchmarking to a title median

The ACC/Empsight 2025 Senior Attorney median is $201,000 base. A chief IP seat priced there will not close against a general counsel cell of $330,000 base.

03

Ignoring the estate

A life sciences company with one product-defining family should price the seat above a technology portfolio of equal headcount. In our searches the gap was about 9% in base, 2023-2026.

Case: a NYSE-listed semiconductor group in Austin created its first head of IP seat after a licensing dispute. The brief started as a patent prosecution manager at $280,000 base. After a mapping of sitting heads of IP and deputy general counsel, the mandate moved to a licensing-and-litigation remit, and the seat closed at $410,000 base in 12 weeks. The remit changed the band, not the market.

Chief IP counsel salary: common questions

What is a chief IP counsel salary in 2026?

No public survey prints a chief IP counsel median. The nearest dated cells are from the ACC/Empsight 2025 survey (data effective 1 March 2025): $245,000 base for an associate general counsel and $330,000 base ($410,000 total cash) for a general counsel or chief legal officer. In Sartori searches closed 2023-2026 (n=14), base for a chief IP counsel or head of IP ran $270,000-$540,000 depending on industry and company size, before bonus and equity.

How much does a head of IP earn compared with a general counsel?

A head of IP at a listed company typically sits one level below the general counsel. ACC/Empsight 2025 puts GC/CLO median base at $330,000 and associate general counsel at $245,000. In Sartori searches closed 2023-2026, head-of-IP base landed at 78% of the same company's general counsel base (n=9 paired seats).

Does a patent-led chief IP counsel earn more than a licensing-led one?

In Sartori searches closed 2023-2026, patent-led seats (prosecution, litigation, portfolio strategy) carried a median base about 6% above licensing-led seats, while licensing-led seats paid a higher bonus share tied to deal revenue (n=14). The gap narrows when the licensing program is a revenue line for the company.

Do life sciences companies pay a chief IP counsel more than tech companies?

In Sartori searches closed 2023-2026, life sciences seats (n=5) closed at a median base 9% above tech seats (n=6), because a patent estate there is the asset the valuation rests on. Tech seats paid more in equity at growth-stage companies.

Is a head of IP salary the same as a patent attorney salary?

No. A patent attorney is a practitioner. Milbank's lockstep for an eighth-year associate is $455,000 base from 1 July 2026, but it is a firm scale for billing work. A head of IP carries a budget, outside-counsel panel, board reporting and often licensing revenue, and is paid against ACC in-house title medians plus equity.

How long does it take to hire a chief IP counsel?

Sartori median for a general counsel or chief legal officer search is 24 days to shortlist and 11 weeks to an accepted offer (52 GC/CLO placements since 2017). Chief IP searches closed 2023-2026 ran a median of 12 weeks to an accepted offer (n=14), because the pool of people who have run both prosecution and a licensing program is small.

What should a company offer a first head of IP?

At a venture-backed company at Series C or later, Sartori searches closed 2023-2026 (n=3) paired a base of $270,000-$350,000 with meaningful equity. A listed company should benchmark against the ACC/Empsight 2025 associate general counsel and general counsel cells and then price the patent estate it is asking that person to own.
