Lawyer salary in South Dakota, 2026: the median is not the Sioux Falls seat.
Employed lawyers in South Dakota posted a $102,040 median in the May 2025 Bureau of Labor Statistics survey. Sioux Falls posted $112,260. The seat a trust company or a bank actually fills is priced off the upper quartile, not off that statewide middle.
The dated number is not the offer that closes in Sioux Falls.
South Dakota employed lawyers posted a median of $102,040 in the Bureau of Labor Statistics May 2025 wage estimates. That dated number is not the 2026 lawyer salary a Sioux Falls trust company or bank is failing to fill.
Sartori maps about 67,000 lawyers in New York. That is a coverage file, not a wage survey, and it is how this desk reads a thin market rather than a convenience sample. The global map behind it covers 1,480,000+ lawyers. Quarterly surveys have run since 2019. The question belongs to two readers at once: the general counsel or chief legal officer who has to put a lawyer on a South Dakota payroll, and the lawyer who will earn the 2026 figure. The opening fact is the same for both. The posted salary that is not closing is not a missing lockstep. It is a statewide median being used as if it were a Sioux Falls offer.
| Layer | Figure | As of | What it measures |
|---|---|---|---|
| BLS South Dakota median | $102,040 | May 2025 | All employed lawyers, SOC 23-1011 — firm, in-house, government |
| Sioux Falls SD-MN median | $112,260 | May 2025 | Employed lawyers in the Sioux Falls MSA, same survey |
| Rapid City median | $99,430 | May 2025 | Employed lawyers in the Rapid City MSA, same survey |
| Sioux Falls 75th percentile | $160,510 | May 2025 | Upper quartile of employed Sioux Falls lawyers — near the Minneapolis median, not a class-year scale |
The Sioux Falls median of $112,260 sits $10,220 above the state median of $102,040. The Sioux Falls 75th percentile of $160,510 sits $890 above the Minneapolis-St. Paul-Bloomington median of $159,620 on the same May 2025 survey. A general counsel who treats $102,040 as the offer is not being conservative. They are pricing a blend of Rapid City, west-river, and public desks against a Minnehaha County seat whose upper quartile already overlaps the Twin Cities middle.

Four published layers, none of them the same object.
Before a general counsel sets a 2026 number, the file has to say which published layer the number is answering. Mixing them is how a Sioux Falls offer reads as market to the board and below the local quartile to the candidate.
WageDex, compiling the Bureau of Labor Statistics May 2025 release and dated 10 August 2026, put South Dakota lawyers at a median of $102,040 and a mean of $132,270, on 1,360 wage-and-salary jobs. The state ranked 49th of 53 states and territories on that median, 36 percent under the national lawyer median of $159,670. The dollar gap is $57,630. O*NET’s reprint of the same survey prints the tails the median hides: 10th percentile $76,920; 25th $85,640; 75th $141,270; 90th $234,690. The mean sits $30,230 above the median because that 90th tail is in the average. A head of legal who averages the mean and the median has invented a fifth layer.

Source: O*NET, Bureau of Labor Statistics 2025 wage data, SOC 23-1011. West-area employment of 250 is the DLR LMIC West Area file of the same survey, published June 2026.
Rapid City’s median of $99,430 is $2,610 under the state median. The west nonmetro median of $100,430 is $1,610 under it. Sioux Falls is the only in-state area on this table whose median clears the state cell, and it clears it by $10,220, not by a lockstep step. The Iowa lawyer salary page owns the Sioux City row of $120,790. Copying that border median onto a Sioux Falls requisition is the same mistake as copying the state median, in the other direction.
The state median is a blend. The Sioux Falls seat is a quartile.
Who is hiring this seat in South Dakota now.
The 2026 salary that will not close is being bid by desks the OEWS median does not separate: trust companies, bank and health-system counsel in Sioux Falls, and a public bench the wage survey folds into the same $102,040.
The lawyer stock and the lawyer jobs are different counts. The ABA’s 2025 National Lawyer Population Survey put resident active attorneys in South Dakota at 2,061, up from 2,042 in 2024, a 0.93 percent increase. The ten-year change from 1,939 in 2015 is 6.29 percent. Wage-and-salary employment on the May 2025 OEWS is 1,360. Licenses are not jobs. A general counsel who staffs to the bar census will overstate the employed pool. A general counsel who staffs to 1,360 will still be looking at a blend, not at trust counsel.
The buyer the median does not describe is the trust charter. SDPB, on 5 May 2026, reported Division of Banking figures: assets in South Dakota trusts were about $906 billion at the end of 2025, up $91 billion, or 11 percent, from 2024, and the highest dollar amount the state had recorded. That increase followed a departure. A crypto custodian, BitGo, converted to an uninsured national trust bank in December 2025 and left the state system. SDPB reported that no crypto custodian remained. The charter count still dipped, for the second straight year: 118 trust companies in 2023, 115 in 2024, and 114 at the end of 2025, of which 69 were public and 45 private. The prior year’s print, which SDPB reported on 28 May 2025, was $815 billion, up $135 billion from $680 billion. The asset book grew. The OEWS median did not become a trust-counsel scale.
Sioux Falls is where that charter work sits next to a credit and health-care payroll, and the Bureau of Labor Statistics measured the mix on 22 July 2026. Legal occupations were 0.5 percent of Sioux Falls employment, against 0.8 percent nationally, with a legal-group mean of $53.30 an hour against a U.S. legal-group mean of $67.07. Healthcare practitioners were 9.7 percent of local employment. Inside office and administrative support, loan interviewers and clerks were employed at 3.81 times the national rate, and bill and account collectors at 4.00 times. Those location quotients are the banking operations footprint. They are not a count of in-house lawyers, and they are not a salary. They tell a chief legal officer why a Sioux Falls headquarters can be a large employer of credit staff and a thin employer of lawyers at the same time.
The pipeline into that thin bar is local, and it is not a large-firm ladder. The University of South Dakota Knudson School of Law’s ABA employment summary for the Class of 2025, status as of 16 March 2026, records 73 graduates. Forty-six were employed in South Dakota, five in Iowa, and five in Nebraska. Of the class, 21 went to firms of 1 to 10 lawyers, five to firms of 11 to 25, two to firms of 26 to 50, and two to firms of 51 to 100. None went to a firm of 501 or more. Business and industry accounted for 7, government for 12, state and local clerkships for 12, federal clerkships for 3, and public interest for 8. Thirty of 73 graduates entered a law firm, and every one of those firms had 100 lawyers or fewer. A 2026 Sioux Falls offer framed on a national first-year scale is recruiting from a class the school’s own form does not show.
Why a 2026 lawyer salary South Dakota posting is not closing.
Three mechanisms, one metro: a state median that blends Rapid City into Sioux Falls, an upper quartile that already matches Minneapolis, and a bar rule that keeps a Twin Cities lawyer from walking in on a score.
State medianThe cell that clears
- Statewide blend Rapid City and the west nonmetro pull the middle down. A Pierre public desk and a Sioux Falls trust desk share that cell only on the survey.
- Sioux Falls middle The honest metro middle. A posting that stops here has not reached the commercial quartile.
- Sioux Falls upper quartile Already on the Minneapolis median. The candidate who can see both will treat a state-median draft as a signal, not as a start.
The desk that reads this pattern has worked associate and in-house searches for more than ten years. Across 1,675 structured interviews with New York partners and counsel, the recurring compensation fact in a thin market is that the candidate prices the nearest large cell, not the host state’s published median. South Dakota is that pattern with a printed upper quartile: the Sioux Falls 75th and the Minneapolis median are $890 apart. The Minnesota lawyer salary page owns the Twin Cities table. This page only needs the one comparison.
The mandate file is the New York associate book, not a second South Dakota count. Of 33 closed associate searches over three years, the completion rate is 94 percent and the counter-offer incidence is 37 percent. Median offer-to-acceptance is 11 working days. The typical timeline is 6 to 12 weeks. Inside that book, a privately chartered trust company in Sioux Falls hired trust counsel in 13 weeks. The first band was the state median. The file closed past that band, once the number moved. Thirteen weeks is one file. It is not a new median.
The opening number was the state median. The counsel we needed was already pricing a Minneapolis desk. That is the payer’s version of the same gap. A hiring manager who waits for a compensation committee to bless $102,040 is using a cycle the 11-day acceptance window does not leave room for. The lawyer who earns the figure hears the silence, or the low print, as the offer.
The opening number was the state median. The counsel was pricing Minneapolis.
The trust statute and the bar rule bidding the same names.
The 2026 salary collision is not a mood. It is a charter book that still needs counsel, a privilege statute that took effect on 1 July 2026, and an admission rule that does not let a Minneapolis score walk into Sioux Falls.
Any qualifying practiceSouth Dakota admission
- Motion, if the years exist Active practice in a reciprocating state, for the statutory window. Inside counsel for a corporation or a trust department counts. A first-time hire does not.
- Legacy exam, last sitting The Board of Bar Examiners set a last legacy sitting. A start that cannot use the motion is on that calendar, not on a transferred score.
- NextGen, first administration The first South Dakota NextGen sitting. A company hiring now cannot wait for it, and cannot treat it as a current waiver.
Senate Bill 100 is the 2026 trust instrument a general counsel can actually date. The Division of Banking’s memorandum 20-036, dated 1 June 2026, says the bill was introduced for the Governor’s Trust Task Force, signed by the Governor, and effective 1 July 2026. Two sections change the counsel’s work. The trustee may, unless the instrument says otherwise, reimburse a trustor for income tax on trust income, or pay the taxing authority directly, where the trustor is treated as owner under the grantor-trust rules. And the attorney-client privilege in the fiduciary relationship stays with the fiduciary. Beneficiary status does not waive it, even when fiduciary funds pay the lawyer. That is a drafting and advice seat at the trust company. It is not a headcount formula, and it does not publish a wage.
The admission rule is the other half of the same hire. SDCL 16-16-12.1 lets an applicant seek admission without examination after three of the last five years of active, continuous practice in a reciprocating state. The statute lists inside counsel for a corporation, agency, association, or trust department as qualifying practice, alongside firm practice, judging, and government work. The National Conference of Bar Examiners’ jurisdiction page lists South Dakota as not accepting a transferred legacy UBE score, and sets the first NextGen administration in July 2027. The Board of Bar Examiners’ own notice matches the calendar: the last legacy examination is February 2027. A Sioux Falls general counsel who wants a Minneapolis lawyer in the chair in 2026 either has a motion candidate with the years, or has an exam candidate. The OEWS median is silent on which.
Take-home is the third object, and it is statutory rather than surveyed. The Tax Foundation’s 2026 tables list South Dakota’s individual income tax as none as of 1 January 2026. The same profile records no corporate income tax and no estate or inheritance tax. Minnesota, on the income-tax table, is a graduated-rate state. A lawyer comparing a Sioux Falls offer with a Minneapolis offer is comparing a wage that the state does not tax with a wage that it does. That wedge does not turn $102,040 into $160,510. It does mean a company that matches only the headline, and ignores the tax, has not priced the move the candidate is actually running.
North Dakota sits on the same NextGen timing. The salary table for that state is on the North Dakota lawyer salary page. It is a border credential, not a second set of South Dakota percentiles.
What the general counsel should print, and what the lawyer should hear.
The South Dakota file that ran long opened on the state median. One reader pays the Sioux Falls seat. The other earns it.
Your exposure is the Sioux Falls quartile and the admission path, not the statewide middle. The file that ran long had opened on $102,040.
- Print the layer you mean. State median, Sioux Falls median, and Sioux Falls 75th are three numbers. A requisition that says “market” without saying which one will be read as the lowest.
- Separate trust counsel from the OEWS blend. About $906 billion of trust assets and 114 charters describe the work. They do not describe the wage. Budget the seat against the quartile the candidate can already see.
- Decide the license before the band. Three of the last five years, with reciprocity, is a motion. Everyone else is an exam, and the legacy exam’s last sitting is February 2027. A score from another UBE state does not transfer.
- Budget the counter. The line’s counter-offer incidence is 37 percent of 33 closed searches. A trust company that opens low will meet the sitting employer’s number inside an 11-day window.
- Do not import a class-year scale you do not have. The national matching-firm floor is a different product, kept on the BigLaw scale page. The Knudson class of 2025 sent nobody to a firm of 501 or more.
Your comparable is the Sioux Falls 75th and the Minneapolis median, not the statewide $102,040, and not a national scale this metro’s graduating class did not join.
- Read the percentile, not the headline. $112,260 is the metro middle. $160,510 is the upper quartile. A trust or bank seat that is genuinely commercial belongs in a conversation with the second number.
- Price take-home, not only headline. South Dakota does not tax wages, as of 1 January 2026. A Minneapolis print and a Sioux Falls print at the same dollars are not the same check. The gap does not erase a $48,250 difference between the Sioux Falls median and the Sioux Falls 75th.
- Know which door the seat uses. Inside-counsel years can support admission without examination. A legacy UBE score does not transfer. Ask in the first call whether the role is motion, exam, or already licensed.
- Watch the asset book without treating it as your wage. Charter assets at about $906 billion say the work is real. They do not say the median moved. The charter count fell to 114.
- The acceptance window is short. On this line it is measured in 11 working days. A state-median draft that needs a committee cycle will lose the week.

What a South Dakota lawyer salary headline leaves out.
The state median is the number a posting copies. It is not the number a Sioux Falls upper-quartile lawyer earns, and it is not the number a trust statute creates.
The asset boom is the fact a salary headline is tempted to misuse. From the 2024 print of $815 billion to the 2025 print of about $906 billion, the book rose while the charter count fell from 115 to 114, and a crypto custodian left for a national charter. Growth in assets with a flat-to-down charter list is a counsel-intensity story, not a hiring wave and not a wage increase. A company that adds one trust counsel because the book grew by $91 billion is making a staffing judgment. The OEWS survey will not confirm it, and it will not price it at $102,040.
The graduating class is the other hidden object. Thirty of 73 Class of 2025 graduates entered firms of 100 lawyers or fewer, and none entered a firm of 501 or more. Twelve entered government and twelve entered state or local clerkships. That is a public and small-firm distribution. It matches a state median of $102,040 better than it matches a Sioux Falls 75th of $160,510. A lateral hire at the 75th is not being recruited from that class’s modal job. Treating the class profile as the wage, or the wage as the class profile, is how both sides of the offer miss.
Sartori’s quarterly survey, running since 2019, has recorded the same pattern the mandate file shows on this line: a posting that opens on the host state’s median loses the first conversation in the week the candidate can see the nearest large-metro cell. In South Dakota that cell is printed. It is the Sioux Falls 75th, $890 from Minneapolis. The research method is on our research page.
Lawyer salary in South Dakota: questions from both sides of the offer
What is the lawyer salary South Dakota figure for 2026?
The May 2025 OEWS median for South Dakota lawyers is $102,040, on 1,360 wage-and-salary jobs. WageDex compiled that Bureau of Labor Statistics cell on 10 August 2026 and ranked the state 49th of 53. The mean is $132,270. Sioux Falls prints $112,260 and Rapid City $99,430 on the same table. None of those cells is a trust-counsel offer or a Minneapolis lockstep.
How does lawyer salary Sioux Falls sit against the state median?
Sioux Falls, SD-MN employed lawyers posted a $112,260 median in May 2025, which is $10,220 above the state median of $102,040. The Sioux Falls 75th percentile is $160,510, $890 above the Minneapolis-St. Paul-Bloomington median of $159,620. A company that budgets the state median for a Minnehaha County seat is pricing a different job from the one the upper quartile already prints.
Does a South Dakota company have to match Minneapolis to hire counsel?
Not as a statute. As a conversation, the Sioux Falls 75th of $160,510 already sits on the Minneapolis median of $159,620. South Dakota imposes no individual income tax on wages as of 1 January 2026, and Minnesota does. The same headline dollars are not the same check. A posting that opens on $102,040 asks the candidate to ignore both the local upper quartile and the Twin Cities cell.
Can a company hire in-house counsel who is not yet licensed in South Dakota?
Admission without examination under SDCL 16-16-12.1 requires active practice as a principal occupation for three of the last five years, in a state that offers South Dakota lawyers a substantially similar path. Inside counsel for a corporation or a trust department counts. The National Conference of Bar Examiners lists South Dakota as not accepting a transferred legacy UBE score. The first NextGen sitting is July 2027. A 2026 start that cannot use the motion still sits the legacy exam, whose last administration is February 2027.
What do the trust-company assets change about pay?
They change the work, not the OEWS median. Division of Banking figures reported by SDPB on 5 May 2026 put trust assets at about $906 billion at the end of 2025, across 114 trust companies. Senate Bill 100, effective 1 July 2026, puts the attorney-client privilege with the fiduciary, not the beneficiary, and lets a trustee reimburse a grantor's income tax. That is a counsel seat. It is not a reason to treat $102,040 as the offer.
How long does a South Dakota in-house search take on this desk?
The New York associate line that underwrites this page runs a typical timeline of 6 to 12 weeks, with a 94 percent completion rate on 33 closed searches over three years. Median offer-to-acceptance is 11 working days. A privately chartered trust company in Sioux Falls, inside that book, hired trust counsel in 13 weeks after the first band used the state median.
Wage surveys, the trust book, and the New York research file.
Employed-lawyer percentiles come from the Bureau of Labor Statistics via O*NET. Employment, the mean, and the rank come from WageDex’s compilation of that survey. Trust assets come from the Division of Banking as reported by SDPB. Sartori figures come from the New York associate research file and are marked for review.
