A data privacy lawyer salary quoted as one national number is usually one of two $190,000 IAPP cuts, or the chief privacy officer average, pasted onto a counsel req.

Two IAPP publications from the same 2025–26 wave both print $190,000, and they describe different people. The infographic of 17 September 2025 puts the North America median base across privacy, AI-governance and cybersecurity roles at $190,000. The survey summary of 3 August 2025, fielded March–April 2025 across more than 1,600 respondents, puts average base for AI-governance legal and compliance professionals at $190,000. Adding the two figures double-counts one community. A privacy counsel offer uses one of them, named, or it uses neither.

The counsel-specific overlay in that 3 August 2025 summary is the dual-domain median of $169,700. Half of privacy-plus-AI-governance respondents earn more than that. The same summary reports that half of privacy-only respondents earn less than $123,000, and half of AI-governance-only respondents earn less than $151,800. Additional digital-governance duties add 16 percent on the 17 September 2025 infographic. That 16 percent is the in-house lift IAPP measured. It is an overlay on a privacy program, and the chief privacy officer average of $280,000 is a different job.

ACC and Empsight, data effective 1 March 2025, publish title rows for the U.S. in-house population across specialties: Attorney median base $148,000 and median total cash $160,000; Senior Attorney $201,000 / $228,000; Associate General Counsel $245,000 / $294,000. The group general counsel and chief legal officer row is $330,000 base, $410,000 total cash and $503,000 total target direct compensation. That last row is what the person who signs the privacy counsel offer often earns. It is on the general counsel salary guide. The counsel letter uses the counsel row.

The Bureau of Labor Statistics, in the Occupational Outlook Handbook current as of 27 August 2026, puts the May 2025 median annual wage for all U.S. lawyers at $159,670, on employment of 863,700. The ACC Attorney median base of $148,000 sits $11,670 under that national lawyer median. A counsel-level privacy hire priced only on the Attorney row is under the wage BLS records for the profession as a whole.

Adding the two $190,000 IAPP cuts double-counts one community.

04 How the package is built

Base, a thin bonus, and a long-term incentive most counsel never see.

At counsel level the ACC gap between median base and median total cash is $12,000. The package is mostly salary. Long-term incentive eligibility is the line that changes at the officer seat.

Attorney median total cash is $160,000, which is $12,000 over base. Senior Attorney total cash is $228,000, which is $27,000 over base. Associate General Counsel total cash is $294,000, which is $49,000 over base.

03

Long-term incentive

ACC 2025: long-term incentive eligibility is 17 percent at Attorney and 63 percent at chief legal officer. A privacy counsel at Attorney rank usually has no equity line. The chief privacy officer letter often does.

IAPP’s 2025–26 survey puts the average bonus at 17 percent of base across the privacy profession. That is a profession-wide average, and it includes officers. The $12,000 cash-over-base on the ACC Attorney row is 8.1 percent of the $148,000 median base. A company that copies the 17 percent IAPP bonus onto an Attorney-title privacy counsel is paying the profession-wide average bonus on a counsel base. Write the percent against the title, and say which survey it came from.

Company size moves the buyer’s own pay, and it moves what the department can clear for a specialist. The 16 September 2025 ACC and Empsight release states that chief legal officers at companies of $5 billion or more in revenue earn 44 percent more base, and 173 percent more total target compensation, than chief legal officers at companies below $1 billion. A privacy counsel inside a department whose general counsel is on the lower side of that split will not clear a chief privacy officer average. The revenue test belongs in week one of the brief. When to open the seat at all is covered in when to hire privacy and AI-governance counsel.

Where the full-time seat is not approved and the calendar is already live, the interim privacy or AI intercept rate we use is $1,600–$2,800 a day in the United States. Days billed are credited against a later retained fee. The retained fee, if the company then hires, is 25–30 percent of total first-year compensation, with 30 percent of the fee paid at engagement.

Long-term incentive eligibility is 17 percent at Attorney and 63 percent at chief legal officer.

05 Title and remit

Privacy counsel, chief privacy officer, or the associate who has not left.

Three seats, three cash systems. Counsel prices an in-house title. The officer average and the lockstep grid stay on their own seats.

Privacy counsel
  • In-house title: Attorney or Senior Attorney
  • Product counseling, notices, vendor terms, state-law map
  • Reports to the general counsel or a deputy
  • Cash: ACC title row, then the $169,700 dual-domain check
Chief privacy officer
  • Officer of the program
  • Owns the program, the vendor stack, the incident line
  • Often a direct line to the executive team
  • IAPP average base $280,000, 17 September 2025

Chambers USA 2026 keeps a Privacy table and a Cybersecurity table. ACC’s 2025 survey places privacy near the bottom of 35 legal specialties on median total cash, with cybersecurity on its own row. The firm-versus-in-house attorney comparison, including the $235,000 first-year base effective 1 July 2026, is on the data privacy attorney salary page. The offer letter uses the counsel title: Attorney or Senior Attorney, then the $169,700 dual-domain check.

The statutory data protection officer, under Articles 37 to 39 of Regulation (EU) 2016/679, is a third design again: independence, a designation, and a reporting line the company cannot casually fold into product counseling. That search is data protection officer search. A US privacy counsel who also holds a European designation is still paid on the US title row unless the letter creates the officer seat. The scale associate is a third cash system: fifth-year base $385,000 and first-year base $235,000, effective 1 July 2026.

The dollar follows the remit.

Milbank’s scale, announced 2 June 2026 and effective 1 July 2026, runs from $235,000 at the first year to $455,000 at the eighth year at firms that matched. Fifth-year base on the Biglaw Investor 2026 table is $385,000. Senior Attorney median total cash in the ACC 2025 survey is $228,000, a $157,000 gap before the firm bonus that sits on the $385,000. Eighth-year base of $455,000 against Associate General Counsel median total cash of $294,000 is a $161,000 gap on the same method. ACC 2025 long-term-incentive eligibility is 17 percent at Attorney, so equity has to be written into the letter if the company expects that associate to move.

The workload those people are hired to carry is dated. IAPP’s US State Comprehensive Privacy Laws Report 2025 counts 19 states with comprehensive privacy laws as of July 2025. No new state enacted a comprehensive law in 2025; eight amended an existing law by mid-year. IAPP’s US Data Privacy Litigation Report 2025 records nearly 2,000 data-privacy lawsuits filed in U.S. federal courts in 2024. The COPPA amendments in the Federal Register of 22 April 2025 carry a compliance date of 22 April 2026. A counsel requisition limited to the CCPA misses that 19-state map and the 22 April 2026 children’s-privacy compliance date.

Across 1,675 structured interviews with New York partners and counsel, 118 were privacy counsel or product-privacy counsel over the 24 months ending September 2026. 54 of those 118 named the gap between fifth-year base and the Senior Attorney median as the reason they stayed at the firm. The research program maps 1,480,000+ lawyers.

Of 18 privacy-counsel searches opened since 2017, 14 placed and 4 were still open past week 12. The four that stalled had asked one person to run product counseling and incident response in the same seat. The 14 placements sit inside 87 senior and specialist in-house counsel placements since 2017, which themselves sit inside 400+ placements since 2017 (230+ in-house). The neighboring senior-counsel clock is 18 days to shortlist and 8 weeks to an accepted offer. Privacy and AI-governance counsel run one day and one week longer: 19 days and 9 weeks.

The published file on that clock is a privacy and AI-governance counsel for a Euronext-listed insurer in Brussels: shortlist in 19 days, accepted offer in 9 weeks. A separate US file, a first privacy counsel for a NASDAQ-listed software company in Seattle, took 22 days to shortlist and 12 weeks to an accepted offer. The general counsel there said, We had priced the seat off a chief privacy officer average. The counsel who accepted sat on a senior attorney package.

Offer acceptance on retained corporate mandates is 96 percent. Retention of placed in-house leaders is 97 percent at 12 months and 91 percent at 24 months. The replacement term on a privacy counsel search is 6 months. General counsel, chief legal officer and chief compliance officer searches carry 12 months. The fee is 25–30 percent of total first-year compensation, and the retainer is 30 percent of the fee.
