Legal Recruiters San Francisco for Unfilled In-House Seats

The San Francisco chair that stays empty is a company seat — a general counsel, chief legal officer, or head of legal — that a posting has not filled. We run the retained search that covers it, and the firm mandate beside it.

Brief a San Francisco search In-house counsel considering a move
01 The uncovered seat

The San Francisco chair that is still empty sits on a company payroll.

San Francisco is not short of licenses. The State Bar of California's county table, fetched on 7 October 2026, listed 17,701 active attorneys in San Francisco County and 9,521 in Santa Clara County. General counsel and heads of HR usually call after that stock has failed to produce one counsel who will take the company chair.

Sartori's San Francisco interview cohort (350 structured interviews) shows the uncovered seat sitting first on a company payroll: a general counsel, a chief legal officer, a head of legal, or a product, privacy, or commercial counsel inside a technology legal department. Across 96 company hiring managers in that cohort over a 24-month window, 61 named product, privacy, or commercial counsel as the chair that stays open longest.

The California hub, covering Los Angeles and San Francisco, opened in 2024. Over the last three years we closed 22 in-house searches on this line, at a 94 percent completion rate, on a median of 12 weeks inside a typical window of 8 to 16 weeks. The firm-side associate and partner product is real. It is not the chair this page opens on.

02 Who hires it

The employer is a legal department, not a law-firm intake form.

In-house is a distinct employer in San Francisco. The company that cannot cover a chair is hiring onto its own payroll — not into the associate class a posting can see.

The county table and the wage release describe different stocks. On 9 July 2026 the Bureau of Labor Statistics reported May 2025 wages for the San Francisco-Oakland-Fremont metropolitan area: the legal occupational group, which includes lawyers and the staff around them, had a mean hourly wage of $91.11, and legal occupations were 1.2 percent of local employment. That mean is not a general counsel salary, and it is not the $235,000 first-year base.

Firm-side supply is the context, not the thesis. Above the Law reported on 2 June 2026 that Milbank raised the associate scale effective 1 July 2026, with a first-year base of $235,000 and an eighth-year base of $455,000. A company that loses a mid-level associate is bidding against that scale, plus unvested equity the firm does not pay. The company chair this page is for is priced on a different card: a Series B–C first general counsel at $240,000–$340,000 base with a 20–40 percent bonus, or a growth-stage or pre-IPO general counsel at $300,000–$420,000 base with a 30–60 percent bonus.

Santa Clara County's 9,521 active attorneys are a Peninsula and South Bay stock, not a synonym for the San Francisco County figure. A brief that says “Bay Area” and means a Palo Alto payroll is a different search from a chair that reports in San Francisco. The city page for coverage, practices, and how a local search is scoped is San Francisco. Los Angeles, the other city on the California hub opened in 2024, is a separate market: Los Angeles.

Of the 22 closed San Francisco in-house searches over three years, 6 were standing general counsel, chief legal officer, or head of legal chairs, 10 were product, commercial, or privacy counsel, and 6 were first-counsel or associate general counsel builds. Firm buyers who want an associate or a partner are on a different line, quoted below as its own product.

We thought we needed a full-time GC. They said fractional for two quarters, then a permanent search. Both were right. The fractional counsel started in a week.

03 Why it stays open

License density is not a person the board will put on payroll.

A county with 17,701 active attorneys can still fail to produce one counsel the company will appoint, on terms the candidate will sign.

Sartori maps about 14,000 lawyers in San Francisco. That figure is coverage: who can be reached for a San Francisco chair. It is not the State Bar census, and it is not a count of open jobs.

Of 58 heads of legal at venture-backed companies inside the same interview cohort, over a 24-month window, 33 said they could not advertise the first general counsel chair while a financing was live. Of 22 closed San Francisco in-house searches over three years, 5 ran past the 16-week end of the typical window. Almost all of those five were first-counsel decisions the board had not made between a fractional cover and a full-time hire. We cannot outrun a company that has not chosen which chair it is buying.

Credential gates are specific. Practicing California law, or holding oneself out as a California attorney, requires admission. An out-of-state lawyer employed to advise that lawyer's employer may register under California Rule of Court 9.46 as Registered In-House Counsel. Business and Professions Code section 16600 makes a noncompete void. SB 699, effective 1 January 2024, confirms the covenant is void regardless of where it was signed and gives the lawyer a civil action. A San Francisco offer that still depends on a noncompete to “protect” the hire is briefing a clause the statute already struck.

Equity is the other gate. An unvested refresh grant freezes more San Francisco moves than base salary does. The firm-wide general counsel clock is still the published one: shortlist in 24 days, accepted offer in a median of 11 weeks, across 52 general counsel and chief legal officer searches since 2017. The San Francisco in-house median of 12 weeks is the whole in-house line, counsel seats included, not a second general counsel clock.

04 What we run

Four products, one city. The telemetry on this page is the in-house line.

Legal recruitment San Francisco splits as soon as the buyer is named. A company is hiring onto a payroll. A firm is hiring a fee-earner. The numbers do not cross.

01

General counsel, CLO and head of legal

Standing company chairs: first general counsel, successor general counsel while the incumbent remains, chief legal officer, and head of legal at a venture-backed or listed technology company. This is the uncovered seat the page opens on.

02

Product, privacy and commercial counsel

The nested seats inside a San Francisco technology legal department: product counsel, privacy counsel, commercial counsel, and the associate general counsel who owns a business line. The title says counsel; the work is vendor contracts, CPRA notices, and model terms.

03

Associate seats for San Francisco firms

When a San Francisco firm buys a retained associate search — corporate, technology transactions, intellectual property, litigation, employment — we run it as a firm mandate, not as a company general counsel search. Credential: California admission, or a registration path the firm will actually sponsor.

04

Partner seats for San Francisco firms

Retained partner search for firms with a San Francisco office. The buyer is the firm. Firm-side cash sits on the published associate scale and on the partner-pay notes linked below. It is a different product from the in-house line.

A composite from that in-house telemetry: a venture-backed software company in San Francisco needed a product counsel after a commercial launch that the outside firms were staffing by the month. The first shortlist was rejected because the brief still described a lockstep associate. We rewrote it as a company chair with CPRA notices and model-vendor terms. The file closed in week 12, from a sitting product counsel, not from a first-year on $235,000. San Francisco in-house telemetry records a counter-offer on 28 percent of files. This file took one and still signed inside the 15-working-day median.

A second composite, and the one that does not flatter the method: a listed software group needed a successor head of legal while the incumbent remained. The board would not name the search for the first quarter. The file was one of the 5 that ran past 16 weeks. Confidential successor work moves when the board will say the sentence, and not before.

The confirmed California file on the general counsel clock is a different chair. A venture-backed SaaS company in California hired its first general counsel from a shortlist on day 24, with an accepted offer in week 10. That file sits among the 52 general counsel and chief legal officer searches since 2017. It is not one of the 22.

When the gap is a defined program rather than a standing chair — parental leave, a financing, a launch — the faster product is interim. Of 60+ interim and fractional engagements, a Series C fintech in San Francisco had interim general counsel live on the work on day 6. A separate Series C SaaS company in San Francisco started fractional general counsel in 7 days. Neither file is inside the 22. Company buyers who want the standing team start at in-house and general counsel recruiting, general counsel search, first general counsel, and our work for companies.

Firm-side work is retained search with its own counts. Over the same three years the San Francisco associate line closed 30 searches, and the partner line closed 20. Candidates comparing legal headhunters San Francisco should read those as firm mandates. The hiring company, or the hiring firm, pays. The candidate does not.

The product-counsel chair stays empty because the work is model-vendor contracts and CPRA notices, not a posting title.

05 How the search runs

Retained, exclusive, written down before the first call.

Companies engage us on a retained basis for San Francisco mandates. We agree scope and terms in writing before any approach is made.

  1. 01

    Mandate blueprint

We write the chair before we name a person: reporting line, whether the hire will practice California law or advise one employer, equity that is still unvested, and whether the sitting general counsel will be told. A San Francisco brief that still reads as a law-firm partner is rewritten as a company seat. Full-time versus fractional is decided here, not after the first slate.

  2. 02

    Market map

We map the relevant in-house bench — product, privacy, commercial, and first general counsel at venture-backed and listed technology companies — then the firm-side supply that might move in. No posting. No job-board scrape. The San Francisco map is a coverage figure, not the State Bar census.

  3. 03

    Blind outreach

Approaches go to sitting counsel who are not looking. The company is not named until both sides have agreed a qualified conversation. San Francisco is a compact, talkative market; exclusivity is the process, not an optional extra.

  4. 04

    Credential and conflicts screen

We test California admission, Registered In-House Counsel status under California Rule of Court 9.46 where the lawyer is out-of-state, and competitor-wall language in the employment agreement. Business and Professions Code section 16600 voids a noncompete. Internal conflicts with the company's outside firms are surfaced before the shortlist.

  5. 05

    Offer engineering

We set cash against the published poles that actually move San Francisco candidates, then hold the 15-working-day offer-to-acceptance window on the in-house line. Counter-offers are expected: San Francisco in-house mandate telemetry records them on 28 percent of files.

  6. 06

    Close and ramp

Notice, start date, and the first 90 days are part of the mandate. A placement counts when the lawyer is in the chair, not when the term sheet is signed. A defined gap can run as interim cover while the permanent search stays live.

Completion on the San Francisco in-house line is 94 percent. Median time-to-fill is 12 weeks, inside 8 to 16 weeks. Median offer-to-acceptance is 15 working days. Offer acceptance on corporate mandates is 96 percent. Retention of placed in-house leaders is 97 percent at 12 months and 91 percent at 24 months. Sartori's research program maps 1,480,000+ lawyer profiles. The full method — mandate blueprint, total-market mapping, blind outreach, vetting, offer engineering, close — is on our methodology.

In four quarterly survey waves since 2025, 19 of 46 San Francisco in-house hiring-manager responses arrived with a firm-side title on a company chair. We send those briefs back. A search that starts as “partner-equivalent” will not produce a general counsel the CEO will appoint.

The fee is 25–30 percent of the hire's total first-year compensation. Thirty percent of the fee is paid as a retainer at engagement. A 12-month replacement term applies to retained general counsel, chief legal officer, and chief compliance officer searches. Other in-house searches carry 6 months. Since 2017 the firm has completed 400+ placements (230+ in-house), 52 of them general counsel or chief legal officer.

Brief a San Francisco search

06 The 2025–26 stack

The company's 2026 calendar is a privacy and patent docket, not a hiring slogan.

Demand for the San Francisco in-house chair is being rewritten by dated instruments. Associate-scale headlines are not the hiring signal.

The California Privacy Protection Agency, on 30 September 2025, required Tractor Supply Company to pay a $1,350,000 fine under the California Consumer Privacy Act. The decision is the agency's largest, and the first to address privacy notices and privacy rights of job applicants: a missing applicant notice, a failed opt-out including Global Privacy Control, and disclosures without the required contracts. A San Francisco privacy counsel chair is that work. It is not a policy memo.

Senate Bill 690 was signed on 30 September 2026, as Jones Walker reported on 2 October 2026. It takes effect on 1 January 2027 and limits private lawsuits over California Invasion of Privacy Act pen-register and trap-and-trace claims that arise from conduct on a website or app, leaving those claims to the Attorney General. It does not repeal the underlying prohibition, and it does not end other website-tracking theories. Companies that spent 2025 and 2026 briefing demand letters still need counsel who can tell a board what changed and what did not. The Northern District of California lists its Patent Local Rules as revised on 11 August 2026. Chambers, in Patent Litigation 2026 published 12 February 2026, counted 105 new patent cases in that district in 2025, tenth nationally.

Pay transparency is already in force. California Labor Code section 432.3 requires an employer with 15 or more employees to put the pay scale in a job posting. A confidential search that is never advertised does not trigger that sentence. The moment the company posts the role, the range goes in the advertisement. That is why a successor general counsel search and a posted senior-counsel requisition run on different clocks in the same city.

The associate scale moved on a published date. Milbank's increase, reported by Above the Law on 2 June 2026, took effect on 1 July 2026: $235,000 at the first year, $455,000 at the eighth. A general counsel who matches only the old printed scale is briefing against a number the market left in June. Compensation notes for the company side and the firm side are linked in the next section.

07 San Francisco pages

The rest of the San Francisco brief lives on pages we already wrote.

This page owns the unfilled company seat and the retained search that covers it. Compensation, the city hub, and the specialist desks sit on their own URLs.

Technology and financial-company chairs have their own desks: technology general counsel search, fintech general counsel search, and chief privacy officer search. Firm buyers use partner recruiting and associate recruiting. The associate scale is on BigLaw associate salary 2026 and the 2026 scale table. In-house ranges by seniority and metro are on in-house counsel salary.

The national mandate, including who pays and what a retained file may approach, is on legal recruiters. The London company seat, under a different regulator and a different pay pole, is on legal recruiters in London. The engagement model is on working with a legal recruiter. A senior lawyer weighing a move uses the in-house candidate page.

San Francisco legal search — questions companies actually ask

What do legal recruiters San Francisco run for a confidential general counsel hire?

One retained mandate: 22 San Francisco in-house files closed over three years, 94 percent complete, median 12 weeks. Terms are in writing before any approach. Companies engage us on that retained basis. We do not run a confidential successor search as a multi-agency contingency. See how a retained legal search actually runs.

Who hires the uncovered San Francisco in-house seat?

The buyer is a company's general counsel, chief legal officer, CEO, or head of HR, in a county the State Bar listed at 17,701 active attorneys on 7 October 2026. The call is not a posting. Public buyers on this page are technology, life-sciences, and financial companies with a San Francisco payroll. Firms buy associate and partner searches as a second buyer.

How long does a San Francisco general counsel search take?

Across 52 general counsel and chief legal officer searches since 2017, the shortlist arrives in 24 days and the accepted offer in a median of 11 weeks. The firm-wide range is 8 to 16 weeks. The San Francisco in-house line, counsel seats included, shows a median of 12 weeks across 22 closed files. 5 of those 22 ran past 16 weeks.

How are you paid for a San Francisco search?

The hiring company pays a fee of 25–30 percent of the hire's total first-year compensation. Thirty percent of that fee is the retainer, paid at engagement and kept if the search is cancelled. There is no contingency option. Retained general counsel, chief legal officer, and chief compliance officer searches carry a 12-month replacement term. Brief the seat at contact.

Do you recruit San Francisco associates and partners as well as in-house counsel?

Yes: 22 closed files on this page are the San Francisco in-house line, separate from 30 associate files and 20 partner files over the same three years. Those are separate retained products. Company buyers start at in-house and general counsel recruiting. Firm buyers start at associate recruiting and partner recruiting.

What does a San Francisco in-house chair actually pay?

A Series B–C first general counsel is $240,000–$340,000 base, with a 20–40 percent bonus. A growth-stage or pre-IPO general counsel is $300,000–$420,000 base, with a 30–60 percent bonus. The firm-side pole a company is bidding against is a first-year base of $235,000 and an eighth-year base of $455,000, effective 1 July 2026 (Above the Law, 2 June 2026). Read general counsel salary in 2026 and the associate scale.

What credentials does a San Francisco lawyer seat require?

California admission, or Rule of Court 9.46 registration, and a noncompete that Business and Professions Code section 16600 already voids. An out-of-state lawyer employed to advise one company may register as Registered In-House Counsel. SB 699, effective 1 January 2024, lets the lawyer sue on a void covenant even if it was signed elsewhere.

Can we cover the chair with interim counsel while the permanent search runs?

Of 60+ interim and fractional engagements, the median start is 7 days, and one Series C fintech in San Francisco was live on day 6. That file sits in the interim book, not in the 22 permanent in-house files. The standing product is interim legal talent and fractional general counsel.

Must a confidential San Francisco search publish a salary range?

No: Labor Code section 432.3 requires a pay scale only in a job posting by an employer with 15 or more employees. A confidential search that stays off the careers page is not that posting. Once the company publishes the role, the range has to be in the advertisement.

San Francisco in-house search

If the chair is still empty, brief it as a company seat.

A general counsel, chief legal officer, or head of legal search in San Francisco is a retained mandate. We listen first — to the reporting line, the California credential, the equity still unvested, and whether the sitting counsel has been told. No obligation.
