An established law firm is seeking an Income Partner to join its Litigation Department in Denver, focusing on construction litigation. The role involves managing a caseload of construction defect matters from intake through resolution, including multi-party residential and commercial defect actions. The partner will also prosecute and defend construction delay, disruption, and acceleration claims on behalf of owners, developers, general contractors, and subcontractors.
Key responsibilities include representing developers, builders, general contractors, design professionals, and subcontractors in construction defect litigation, arbitration, and mediation. The partner will collaborate with engineering, architectural, and forensic experts to evaluate defect claims involving structural, mechanical, electrical, waterproofing, and building envelope issues. Serving as a resource on Colorado-specific construction defect statutes, including the Construction Defect Action Reform Act (CDARA) and applicable statutes of repose and limitation, is essential.
Additional duties encompass analyzing Critical Path Method schedules, working with scheduling experts on delay impacts, reviewing construction contracts and project documentation, and assessing delay damages. The partner will handle general litigation tasks such as drafting pleadings and motions, managing discovery, taking and defending depositions, and participating in mediations, hearings, arbitrations, and trials. Staffing matters, overseeing associates and paralegals, and engaging in business development are also expected.
