Real estate lateral partner recruiting

For managing partners, chairs and real estate practice heads. Who is hiring, what book is typical, how a guarantee should be set, and which covenants actually bind the move.

01 The practice

Real estate is a different underwrite from a general lateral hire.

A real estate lateral partner recruiter is retained by the firm that will carry the guarantee: the managing partner, the chair or the head of real estate. The partner who is thinking about leaving is a different conversation.

The cross-practice method — brief, portability read, Lateral Partner Questionnaire, conflicts clearance, and the first hundred days — is lateral partner recruiting. Real estate changes the book, the demand and the constraint on the move.

Inside a published corpus of 2,600+ partner conversations, real estate partners who report in US dollars (n=16) show a median book near $1.75 million, on a range of $0.1 million to $14 million. Of 40 portability assessments, 32 percent were highly portable, 50 percent partially portable and 18 percent low portability. The common case is not “the book follows.” It is “a share of it might.”

Demand is the 2025 volume print, not a slogan that property is back. MSCI’s briefing of 29 January 2026 records $545.3 billion of US commercial property sales in 2025, up 23 percent. Am Law 100 profits per equity partner averaged $3.59 million in calendar 2025, up 14.0 percent (The American Lawyer’s 2026 rankings, as reported by David Lat on 30 April 2026). A guarantee written as if those two numbers were the same thing is how a real estate lateral fails.

Sector dollars, same briefing: apartments $165.5 billion (up 9 percent), industrial $114.3 billion (up 15 percent), office $81.1 billion (up 26 percent), retail $71.6 billion (up 26 percent), development sites $33.5 billion (up 44 percent), data centers $29.9 billion (up 274 percent). Single-asset sales were $418.8 billion, up 24 percent. MSCI notes that fourth-quarter data-center activity was largely one deal.

01

National platforms, fund and finance coverage

Apartments ($165.5 billion, up 9 percent) and industrial ($114.3 billion, up 15 percent) were the liquid 2025 sectors. Firms hire the partner who can paper the joint venture, the fund sleeve and the financing, not only the deed.

02

Regional practices on the single-asset book

Single-asset sales were $418.8 billion in 2025, up 24 percent. Gateway practices in New York, Los Angeles, Chicago, Dallas, Miami and Washington do that work, and they lose partners to national platforms that can credit originations.

03

Development-site and data-center benches

Development sites were $33.5 billion, up 44 percent. Data centers were $29.9 billion, up 274 percent, and MSCI says the fourth-quarter spike was largely one deal. The hire is site control, power and entitlement, not a standing mergers group.

04

Office, retail and REIT product, separately staffed

Office sales were $81.1 billion, up 26 percent on 2024. On the same briefing, office sector activity is down the most. Retail was $71.6 billion, up 26 percent. REIT counsel is a tax and securities seat, not a leasing seat.

REIT work is a separate hire. A REIT that wants the dividends-paid deduction must distribute at least 90 percent of its REIT taxable income (26 U.S.C. § 857(a)). Firms staff that seat with tax and securities partners, not with the lawyer who runs a leasing roster. The company side of the same market is commercial real estate and REITs. The practice tree, including leasing, land use, REITs and hospitality, is real estate. The published European in-house reading — Milan, London and Paris occupiers, not this firm-side search — is real estate legal: selective recovery or fragile market.

03 The book

About $1.75 million is the center of a wide US-dollar range.

The row below is the published real estate cut of Sartori’s partner interviews. It is not a market census. Partners who discuss a move are the sample.

Real estate, from the published Sartori interview corpus. US-dollar books and portability are different counts. They are not a subset of each other.
Measure n Result
US-dollar book 16 $0.1 million to $14 million. Median near $1.75 million.
Portability, assessed 40 32 percent highly portable. 50 percent partially portable. 18 percent low. Institutional: none in the assessed mix.
Parent corpus 2,600+ Partner conversations. Most practices cluster at a US-dollar median of $2 million to $3 million.

The lower median is structural. Practices built on large single mandates — a fund close, a major arbitration — produce higher books because one or two relationships are the revenue. Real estate, like employment and mid-market corporate, is a run of smaller mandates. The same published note is why the range is tighter than disputes, and why it is still not tight: $0.1 million and $14 million are both real estate.

Portability is the number that should change the offer. Highly portable means the book largely follows the lawyer. That was 32 percent of the 40 assessed real estate reads. Partially portable, 50 percent, means a share follows if someone works the relationship. Low portability, 18 percent, means the book is substantially institutional or panel-driven. The three shares sum to 100 percent, and the published table shows no institutional classification in this practice. A chair who underwrites the headline book is pricing the 32 percent case against a sample that is mostly the other two.

What usually moves is the sponsor who instructs this lawyer, the leasing roster that is personal, and the repeat developer. What usually stays is the fund mandate, the REIT panel and the institutional lender that hired the firm. That split is why real estate sits with corporate on partial portability and not with insurance, where 52 percent of the assessed sample was highly portable. 04 Guarantees

Set the guarantee on originated collections. The median is not the guarantee.

Am Law 100 profitability and a real estate book answer different questions. Mixing them is how a compensation committee overpays.

Calendar 2025, reported in the 2026 Am Law 100: gross revenue $178.95 billion, up 13.0 percent; revenue per lawyer $1.39 million, up 8.7 percent; profits per equity partner $3.59 million, up 14.0 percent (David Lat, Original Jurisdiction, 30 April 2026, reporting The American Lawyer). Headcount grew 4 percent, to 128,868 lawyers. Nonequity partners increased by almost 7 percent. Equity partners grew 2 percent. The partnership got more leveraged. That is the profit pool a lateral is hired into. It is not the draw a real estate book of about $1.75 million can support.

David Lat’s same piece describes the failure mode that matters for the term of a guarantee. Some expensive laterals leave after two or three years because guaranteed compensation ended and pay was about to be reset under the firm’s ordinary system, the partner not having produced enough to hold the number. A guarantee that expires is a date certain. If originated collections will not clear the firm’s grid on that date, the hire was mis-priced on day one.

The base is three to five years of originations, collections, realization and rates, client by client — the economic section of the Lateral Partner Questionnaire, which the general partner search treats as the underwriting file. For real estate, separate originated revenue from matters the partner worked on a firm panel. Only the originated share is a defensible guarantee. Concentration matters more here than the average practice, because a “book” can be four sponsors. Lose one and the $1.75 million median is no longer the right anchor.

Across 11 real estate partner searches since 2017, 3 did not reach an offer. In each of those three, originated collections would not support the guarantee the partner asked for. That is the result we would rather report than a closed search that unwinds when the guarantee ends.

One that did close: a real estate practice chair at a national firm in New York hired a data-center and industrial partner. The shortlist was delivered on day 26. The accepted offer came in week 13. The partner claimed a book of $3.4 million. Originated collections substantiated at $2.1 million. The guarantee was written on the $2.1 million, not the claim. Both figures sit inside the published $0.1 million to $14 million range. $2.1 million is near the $1.75 million median. $3.4 million is not a reason to ignore the median.

The search is retained. The fee is 25–30 percent of the hire’s total first-year compensation. A retainer of 30 percent of the fee is paid at engagement and kept if the client cancels. Income-partner offers are the live alternative to an equity guarantee: the 2025 headcount mix, nonequity up almost 7 percent against equity up 2 percent, is the structure a chair already has available when the book is real but not equity-sized.

05 Covenants

A non-compete is not the instrument. Rule 5.6 is the rule.

Commercial non-compete law and lawyer ethics are different regimes. A real estate start date is usually stuck on notice and garden leave, not on a covenant that bars practice.

ABA Model Rule 5.6(a) provides that a lawyer shall not participate in offering or making a partnership, shareholders, operating, employment, or other similar agreement that restricts the right of a lawyer to practice after termination of the relationship, except an agreement concerning benefits upon retirement. Rule 5.6(b) bars an agreement in which a restriction on the right to practice is part of the settlement of a client controversy. A blanket non-compete, of the kind a fund or a developer might sign with an executive, is not available against the partner you are hiring.

The retirement-benefits exception is narrow. A forfeiture drafted so that the lawyer cannot afford to practice is the thing the rule prohibits, dressed as a pension. What firms actually use, and what we read before a start date is put in a letter, is notice, garden leave while the lawyer remains a partner and is paid, and a non-solicit of clients that does not prohibit practice. Those terms change timing. They do not move a REIT panel.

The FTC’s Non-Compete Clause Rule does not fill the gap. A federal court in Texas set the rule aside in Ryan LLC v. FTC, 746 F. Supp. 3d 369 (N.D. Tex. 2024). On 5 September 2025 the Commission voted to dismiss its appeals and accede to that vacatur. The rule is not in effect. It was never the rule that governs a law-firm partnership agreement. State employee non-compete statutes can still matter for business-staff covenants around a group move. They do not license a partnership to do what Rule 5.6 forbids.

Real estate makes the ethics point concrete. The client who will not move is often the client a non-solicit could not have delivered anyway: the fund, the REIT, the lender on the panel. The client who might move — the sponsor, the repeat developer — is reached by a lawful announcement after resignation, not by racing a covenant. Conflicts are the other gate. A general description is enough to start clearance (“a listed industrial REIT on a joint-venture program”) without putting a privileged file in the hiring firm’s hands. The mechanics of that clearance, and of garden leave as a planned bridge rather than dead time, are phase four and phase five of lateral partner recruiting.

06 Demand, compensation, moves

2025 was a recovery by asset class. Moves follow the portable share.

Office sales rose in 2025. On the same 29 January 2026 briefing, office sector activity is down the most. Hiring follows that distinction.

Chairs adding a partner in 2026 are staffing the sectors that cleared, not rebuilding a 2019 office pyramid. Apartments at $165.5 billion and industrial at $114.3 billion are the liquid books. Development sites at $33.5 billion, up 44 percent, pull land-use and construction partners. Data centers at $29.9 billion, up 274 percent, do not mean a deep bench of data-center M&A partners: MSCI attributes the fourth-quarter spike largely to one deal. The lateral who is scarce is the lawyer who can control a site, a power arrangement and an entitlement, then stay for the lease-up.

Office at $81.1 billion, up 26 percent on 2024, is a real dollar recovery. The same briefing says office sector activity is down the most, on the slide that compares sector liquidity with the pre-pandemic market. A firm that hires an office-leasing rainmaker against that earlier market is buying a history. Retail at $71.6 billion, up 26 percent, is a separate product: shopping-center joint ventures and anchor leases, not a synonym for “real estate.”

What moves with the partner is the sponsor and the personal leasing roster. What stays is the fund mandate and the REIT panel. That is the 50 percent partial-portability result applied to a live mandate. Cross-border demand is the same split at a different scale: a US firm that needs a European real estate fund partner, or a European firm staffing a US industrial desk. The occupier and in-house side of the European market is real estate legal: selective recovery or fragile market. That article does not underwrite a law-firm lateral.

Compensation for the partner is the guarantee discussed above, written on originated collections. Associate lockstep and posted in-house bands are the instrument for the bench underneath, set out in real estate attorney salary 2026. They do not price the partner. Revenue per lawyer of $1.39 million across the Am Law 100 in 2025 is the leverage test: a real estate lateral who arrives without associates the platform can staff will not produce that figure on a book near $1.75 million.

07 How the search is run

Four questions before any name is shown.

The five-phase manual is the general partner search. These four are the real estate additions. We do not approach the market until the chair has answered them.

01

Asset class and product

Industrial, multifamily, office, retail, development sites, data centers, or REIT tax and securities. One label is not a brief.

02

Portable fraction

We price 32 percent highly portable and 50 percent partial as the base rates, then test this candidate’s clients against them.

03

Guarantee base

Originated collections over three to five years. The $1.75 million median is context. It is not the offer.

04

Start-date friction

Notice, garden leave and any retirement-forfeiture clause are read against Rule 5.6 before a date is promised to the partnership.

The New York matter above is the shape of a file that cleared those four questions. Day 26 to a shortlist. Week 13 to an accepted offer. Claimed book $3.4 million, originated collections $2.1 million, guarantee on the originated figure. It is one of 11 real estate partner searches since 2017, and it is not one of the 3 that stopped when the originated share would not carry the ask.

Group moves are the same test, applied to shared clients. A real estate “team” is often a partner, a counsel who holds the lender relationship, and two associates who run closings. If the lender relationship is the firm’s panel seat, the headcount does not travel with the partner. We map that before anyone is approached. The method behind the mapping is the research and search method. Firm-side context for the rest of the partnership is for law firms.

What real estate chairs ask before they commit

What does a real estate lateral partner recruiter do for a law firm?

A real estate lateral partner recruiter runs a retained search for a real estate partner or group and underwrites the book before the firm writes a guarantee. The cross-practice method — market map, Lateral Partner Questionnaire, conflicts and the first hundred days — is lateral partner recruiting. This practice changes the economics: smaller, more fragmented books, partial portability as the common result, and demand that follows 2025 property volumes rather than a single recovery.

Which law firms are hiring real estate partners?

The buyers track the sectors that traded. MSCI's briefing of 29 January 2026 records $545.3 billion of US commercial property sales in 2025, up 23 percent: apartments $165.5 billion, industrial $114.3 billion, office $81.1 billion, retail $71.6 billion, development sites $33.5 billion and data centers $29.9 billion. National firms hire for fund, joint-venture and finance coverage. Regional practices hire, and lose people, on the single-asset book ($418.8 billion, up 24 percent). Data-center dollar volume was up 274 percent and, on MSCI's account, largely one fourth-quarter deal. The practice map is real estate. The company-side industry is real estate, construction and infrastructure.

What is a typical real estate partner book of business?

Inside Sartori's published corpus of 2,600+ partner conversations, real estate partners reporting in US dollars (n=16) showed a range of $0.1 million to $14 million and a median near $1.75 million. That sits under the $2 million to $3 million band that holds most practices on the same table. Of 40 real estate portability assessments, 32 percent were highly portable, 50 percent partially portable and 18 percent low portability. None of that assessed sample was classified institutional. The table is partner book of business by practice.

How should a firm set the compensation guarantee?

There is no published standard term we will treat as a market rule. David Lat, writing on 30 April 2026 about the 2026 Am Law 100, described laterals who leave after two or three years because guaranteed compensation ended and pay was about to reset under the firm's ordinary system. Write the guarantee on originated collections, not the pitched book. Am Law 100 profits per equity partner averaged $3.59 million in 2025, up 14.0 percent, on gross revenue of $178.95 billion, up 13.0 percent. That profit pool is not a real estate partner's draw. A book near $1.75 million does not support a $3.59 million guarantee.

Can a law firm bind a real estate partner with a non-compete?

ABA Model Rule 5.6(a) says a lawyer shall not participate in offering or making a partnership, employment or similar agreement that restricts the right to practice after the relationship ends, except an agreement concerning benefits upon retirement. Rule 5.6(b) bars the same restriction inside a settlement of a client controversy. Notice, garden leave while the lawyer is still a partner, and a client non-solicit that does not bar practice are the instruments that actually affect a start date. The FTC Non-Compete Clause Rule was set aside in Ryan LLC v. FTC, 746 F. Supp. 3d 369 (N.D. Tex. 2024). On 5 September 2025 the FTC dismissed its appeals and acceded to that vacatur. Rule 5.6 is what the partnership has to clear.

How is real estate partner search different from a general lateral search?

The general search underwrites any practice on the same five phases. Real estate changes the book and the demand. The published median is about $1.75 million because the work is a run of smaller mandates, not one fund close. Half of assessed books are only partially portable, which matches sponsor and REIT relationships that sit with the platform. 2025 volumes recovered by asset class, not as one market. Associate and in-house pay, which is a different instrument, is in real estate attorney salary 2026. The European in-house reading is real estate legal: selective recovery or fragile market.

What does the search cost, and on what terms?

Retained only. The fee is 25–30 percent of the hire's total first-year compensation. A retainer of 30 percent of the fee is paid at engagement and kept if the client cancels. We do not run real estate partner mandates on contingency. The cross-practice diligence a guarantee requires is the work described on lateral partner recruiting.

A brief, not a commitment

Name the asset class. We will underwrite the book that can move.

Tell us the gap: fund coverage, a development-site bench, a REIT product, or a partner the region is about to lose. We map the field, test portability before you see a name, and read notice and Rule 5.6 before a start date is promised.
