Sydney 2026: the practicing certificate is the hire.

A general counsel filling an Australian-law seat in this city is not shopping a global resume pile. They are shopping a local certificate, and the pay and the calendar both follow from that gate.

Read the census before you write the requisition.

A general counsel writing a 2026 requisition in this city is staffing against a certificated pool, not against every lawyer who has ever worked here. Sartori maps roughly 6,500 lawyers in Sydney. The legal market Sydney that actually answers an Australian-law seat is the certificated one.

Lens 01 · The statute Unqualified legal practice is a crime, including inside the company.

Uniform Law s.10 prohibits an entity from engaging in legal practice in New South Wales unless it is a qualified entity: 250 penalty units or two years imprisonment, or both. The Legal Services Council corporate-lawyer sheet (July 2022) applies that prohibition to in-house lawyers. NSW transitional relief that allowed some corporate practice without a certificate ended on 1 July 2018. The gate is statutory, not customary.

The dated stock sits in the table below. Pay, the 2026 rule stack, and the calendar for filling a seat follow it. The certificate categories are unpacked next.

02 The credential

The credential gate inside the legal market Sydney

Five solicitor-certificate categories exist under Uniform Law s.47. A general counsel filling an Australian-law seat is buying one of them, not a job title.

No certificateOwn-account practice

  1. Policy, operations, knowledge Uniform Law s.6 carves policy work out of legal practice. A legal-operations or pure-policy hire can sit here. Advice, appearances and holding out cannot.
  2. Corporate or government certificate The in-house and public book. Related-entity advice for companies; core and non-core government work for the Crown Solicitor and agencies. Condition 2 off for sole or supervising seats.
  3. Employee or principal certificate The firm book, and the only category that lets a contractor supply legal services on their own account. A principal certificate plus approved PII is the contractor seat; contractor is not itself a category.

The Law Society of New South Wales, on its categories page and on the 2026/27 grant form dated 13 March 2026, sets five solicitor categories: principal of a law practice, employee of a law practice, corporate legal practitioner, government legal practitioner, and volunteer only. A person may hold only one Australian practicing certificate. Principal place of practice must be New South Wales for a NSW grant. The 2026/27 fee scale (year 1 July 2026 to 30 June 2027) charges a practicing fee of A$550 across principal, employee, corporate and government; a fidelity-fund contribution of A$90 for law-practice principal or employee only; and optional membership of A$440. Totals land at A$1,080 for principal or employee and A$990 for corporate or government. The certificate is cheap. The scarcity is not the fee.

Cross-authorization is the operational fact a head of talent actually uses. An employee certificate also authorizes corporate and government practice, so a general counsel can move a private-practice employee onto an in-house seat without an immediate variation. A corporate certificate also authorizes government practice. Until renewal, that is a bridge. It is not a waiver of admission, and it is not a waiver of Condition 2.

A corporate legal practitioner who practices only as in-house counsel for the employer or a related body corporate does not need professional indemnity insurance, under Uniform Law s.215(8), and does not contribute to the Fidelity Fund, under s.225(4). The Handy hints for in-house lawyers dated 9 January 2025 add the scope limit: the holder cannot provide legal advice or legal services outside that employment other than volunteer or pro bono with approved insurance. Related body corporate is Corporations Act s.50. A group structure that looks obvious on an organization chart can still fall outside that definition; that is a conflicts and independence question, not a branding one.

Uniform Law s.47 categories and the 2026/27 NSW fee totals (practicing fee, fidelity contribution where it applies, optional membership). Authorization is statutory; the buyer column is the 2026 hiring use of each category, not a headcount.
Category Also authorizes Who pays this seat in 2026 2026/27 total Unsupervised in-house
Principal of a law practice Employee, corporate, government, volunteer Firm partners; own-account contractors (who must also hold approved PII) A$1,080 Yes, if Condition 2 is off
Employee of a law practice Corporate and government Associates, senior associates, special counsel; a GC can move this holder in-house without an immediate variation A$1,080 Yes, if Condition 2 is off
Corporate legal practitioner Government Company general counsel, deputy, senior legal counsel; related-body-corporate only A$990 Required: Condition 2 off. A principal certificate is not required for the sole in-house role
Government legal practitioner Corporate Crown Solicitor's Office, Australian Government Solicitor, agency legal teams A$990 Supervising seats still need Condition 2 off
Volunteer only Pro bono / volunteer Not a paid general counsel seat A$440 (membership) No

Foreign-qualified laterals occupy a different column. The Law Society Journal, in a Professional Support Unit note dated 28 February 2024, warned that titles such as lawyer, solicitor or counsel used without an Australian registration certificate or an Australian practicing certificate may breach the Uniform Law even under supervision, and that an ARC holder drafting Australian-law documents must have them settled by an authorized Australian legal practitioner. For the 2026 general counsel, that is the difference between a foreign-law or project seat and Group General Counsel. The admission pipeline that feeds the certificate stock is measured: the Legal Profession Admission Board recorded 2,957 people admitted as lawyers in NSW in 2024-25, of whom 172 had previously been admitted overseas and 105 entered under Trans-Tasman mutual recognition.

The certificate is the product. The shortlist is a search for the product.

03 Who pays the seat

The buyers a general counsel is hiring beside, and against.

In-house counsel in Sydney sit on corporate and government certificates. The companies, funds and public bodies that pay those seats are not a generic commercial market.

01

ADIs, insurers, market infrastructure

Sydney-headquartered banks, insurers and the listed exchange. Legal sits as a Legal and Governance Group or as Group General Counsel and Company Secretary. These are corporate-certificate, FAR-mapped seats.

02

APRA-regulated superannuation trustees

Industry funds with Sydney legal and secretariat benches: general counsel, investments legal, corporate legal, company secretariat. SIS Act, Corporations Act, FIRB and ACCC work is Australian-law advice.

03

NSW and Commonwealth public buyers

The Crown Solicitor's Office is sole provider of NSW core legal work. Australian Government Solicitor in Martin Place covers Commonwealth agencies under the Legal Services Directions. Government certificates; Crown award dollars.

04

Firms the company still instructs

Independent Australian nationals, transatlantic combinations, and international firms with a Sydney office. Australian-law work still needs a local certificate. Foreign-law desks sit on an Australian registration certificate.

The 2025 Annual Profile of Solicitors in NSW, census at 30 June 2025, put 44 percent of corporate certificates in the Sydney CBD and 39 percent in suburban Sydney; 11 percent of corporate certificates were overseas. That is a mid-to-senior book: 51 percent of corporate solicitors had been admitted 15 years or more, against 40 percent in private practice, and only 6 percent of corporate solicitors were aged under 30, against 21 percent in private practice. The June 2026 category stock is in the chart below; the in-house and public desks a general counsel fills are the corporate and government bars.

Start with the financial-services and market-infrastructure employers, because their own reports name the function. Macquarie Group, in its FY2026 annual report, describes a Central Service Group labelled Legal and Governance Group that provides legal and corporate governance services, including strategic legal and governance advice and risk assessment on corporate transactions, treasury and funding, insurance, regulatory enquiries and litigation. ASX Limited, the listed market-infrastructure company headquartered in Sydney, publishes Group General Counsel and Company Secretary as an executive seat over Legal, Company Secretarial and Regulatory Policy, and a separate Group Executive, ASX Supervision, that is a regulatory-operations seat rather than a substitute for the general counsel. Those are corporate-certificate seats. A head of talent at a listed market-infrastructure company told us London-qualified counsel were usable on foreign-law desks only; Australian-law advice still had to sit on an Australian certificate.

Superannuation trustees are the other scaled in-house buyer. A large Sydney-headquartered industry fund announced in June 2026 a combined risk, compliance and sustainability function with legal and company secretariat under a chief risk officer and group executive, governance, with an expanded general counsel and an expanded company secretary reporting into that division from 29 June 2026. Australia’s largest superannuation fund, whose legal department is headquartered in Melbourne with team members in Sydney, has described a 63-person function across Corporate Legal, Investments Legal, Company Secretariat and Legal Operations, of whom 48 sit in Australia: one general counsel, ten company secretariat, 18 corporate legal, 17 investments legal, two legal operations. Investments-legal seats still give Australian-law advice on the SIS Act, the Corporations Act, and FIRB and ACCC work. A head of legal at an APRA-regulated registrable superannuation-entity licensee told us they would not post a sole-counsel role until they could see a corporate certificate with supervision removed.

The public book is not a softer version of the same seat. The NSW Crown Solicitor’s Office, on its “What we do” page last updated 24 July 2024, is the sole provider of legal services in all matters regarded as core legal work under Premier’s Memorandum 2016-04 (issued 1 July 2016, updated 14 December 2023). Core legal work is work where the best interests of the NSW Government as a whole require a single source of authoritative advice, or work relating to the statutory or common-law functions of the Attorney General. The Office also competes with the private sector for non-core work on legal-services panels. Australian Government Solicitor advises and represents Commonwealth agencies under the Attorney-General’s Legal Services Directions; its Sydney office sits at Level 10, 60 Martin Place. APRA (prudential), ASIC (corporate, markets, credit) and AUSTRAC (AML/CTF, Haymarket) run government legal and enforcement desks that instruct AGS and private firms. Those seats sit on government certificates and, for named NSW legal-officer grades, on the Crown Employees award.

Firms remain a buyer, and they remain a competitor for the same certificated people. Independent Australian nationals with a Sydney office include Mallesons, which commenced as an independent full-service firm on 30 March 2026 after a 14-year combination ended, stating more than 1,200 lawyers in Australia and Singapore; Allens, associated with Linklaters; Gilbert + Tobin, which launched a dedicated Real Assets team of more than 40 lawyers on 9 July 2026; Clayton Utz; and Corrs Chambers Westgarth. Transatlantic combinations with a historic Sydney partnership include Ashurst (last full financial year before combination with Perkins Coie, results 23 June 2026) and HSF Kramer (combination live June 2025). International firms with a Sydney office include Clifford Chance and Baker McKenzie. Australian-law work at all three tiers still needs a local certificate. Foreign-law support sits on an Australian registration certificate. Firm-side partner counts from the Australian Financial Review partnership survey are a national series, not a Sydney hiring census, and they are not the spine of this page.

NSW solicitor practicing-certificate stock by category, 30 June 2026. The in-house and public book a general counsel fills is corporate plus government. Volunteer (94) is omitted as too small to plot.

04 What it pays

The survey pays corporate more. The award pays government less. Neither is a payroll file.

A lawyer earning the 2026 Sydney figure and a general counsel paying it are reading the same survey from opposite sides of the offer letter.

Self-reported average gross income, FY2023-24, among full-time and part-time respondents to the Law Society of New South Wales 2025-26 Practising Certificate Survey. The Grade VI award rate is an employer-paid base, not a survey average, and is plotted as a public-sector anchor.

Law Society 2025-26 Practising Certificate Survey, sector average

Annual Profile of Solicitors in NSW, 2025 (income year FY2023-24) ↗

The 2025 Annual Profile of Solicitors in NSW, published July 2026, reports income from the 2025-26 Practising Certificate Survey: 15,464 respondents, a 38 percent response, self-reported gross annual income for FY2023-24. Average income across respondents was A$184,980, up A$5,907 on the prior year. Distribution: 38 percent earned A$100,001 to A$200,000; 21 percent earned A$100,000 or less; 13 percent earned over A$300,000. Sector averages for full-time and part-time respondents were corporate A$235,439, private practice A$194,987, government A$152,978. The corporate average sits A$40,452 above private practice on those two figures. That spread is a survey statistic, not a mandate to match it on every offer.

The right tail is where a general counsel and a candidate actually argue. Among full-time and part-time respondents, 14 percent of corporate lawyers (base 3,205) sat in A$300,001 to A$500,000 and 5 percent sat over A$500,000; private practice (base 8,363) sat at 7 percent and 6 percent in those two bands; government (base 1,854) at 2 percent and under 1 percent. Sixty-one percent of corporate respondents reported over A$150,000, versus 40 percent of private practice and 37 percent of government. This is not a secret in-house discount. On this survey, the corporate book is the expensive book, and it is expensive in part because it is older: unsupervised seats cannot be filled from the graduate intake.

Firm size still moves private-practice pay, which is why a general counsel raiding a 50-plus-principal shop is not raiding a suburban four-principal practice. Table 15 of the same profile (private practice only, 8,618 respondents, size by number of principals) found 35 percent of respondents in practices with 50 or more principals reported more than A$250,000, versus 9 percent in 1-4 principal practices. Over A$500,000: 15 percent in 50-plus principal firms versus 2 percent in 1-4 principal practices. Location among full-time solicitors: 24 percent of major-city full-time solicitors reported incomes over A$250,000 versus 8 percent of regional and remote. A lawyer salary conversation that ignores that split is a conversation about a different state.

Government pay is the one series that is an employer scale rather than a survey. The Crown Employees (Public Sector - Salaries 2024) Award attaches the Legal Officers award for the Crown Solicitor’s Office, Legal Aid, the Office of the Director of Public Prosecutions and the Parliamentary Counsel’s Office. Increases: 4 percent from the first full pay period on or after 1 July 2024; 3 percent from 1 July 2025; 3 percent from 1 July 2026. Legal Officer per-annum rates from 1 July 2026: Grade I fifth year A$93,413; Grade II fifth year A$122,869; Grade III third year A$138,492; Grade IV A$148,380 to A$151,236; Grade V A$159,035 to A$162,153; Grade VI A$170,841 to A$174,440. Those figures exclude superannuation and leave loading. They are why a CSO or agency hire and a bank general counsel hire are not the same compensation conversation, even when both seats require a local certificate.

We do not have a clean, dated, public series for Group General Counsel cash at ASX 100 issuers, and we will not invent one. Recruiter salary surveys are not used on this page. The honest pay picture for a 2026 Sydney in-house brief is the Law Society survey for the corporate book, the Crown award for the public book, and a conversation about equity, deferred remuneration under the Financial Accountability Regime, and whether the seat is combined with company secretary. The Association of Corporate Counsel 2024 in-house trends report put that overlap at 49 percent of Australian chief legal officer respondents, up from 25 percent in the prior ACC Australia wave; 12 percent of respondents were sole legal counsel, 62 percent sat in teams of 2-9 lawyers, and 26 percent in teams of 10 or more. Only 21 percent of chief legal officers exclusively oversaw legal without other functions.

Corporate respondents earned more because the corporate book is older, and unsupervised seats cannot be filled from the graduate intake.
On the corporate premium
05 What is hiring

The 2026 rule stack has a seat, a seniority, and a date. It does not have a workaround.

A general counsel who staffs against a vibe called recovery will over-hire commercial generalists and under-hire the desks the statutes actually moved.

Commencement dates and the in-house or firm seat each instrument actually staffs. Sort by date or by seniority. These are live rules in 2026, not a forecast of headcount.

Thomson Reuters Institute, Australian Legal Market Midyear Update, issued 23 February 2026.

The demand shock a Sydney general counsel can date is merger control. The Treasury Laws Amendment (Mergers and Acquisitions Reform) Act 2024 received Royal Assent on 10 December 2024; the main amendments commenced 1 January 2026. The ACCC, in a media release dated 9 April 2026, recorded 50 merger notifications and 108 waiver applications between 1 January and 31 March 2026, excluding 13 notifications in the 1 July to 31 December 2025 voluntary transition. Thirty-nine notifications were approved in phase 1; two progressed to phase 2. Average phase-1 approval was 18 business days; waivers were decided on average in 11 business days. Ninety-one percent of acquisitions were decided within 20 business days against an 80 percent commitment. Serial acquirers — ADIs, insurers, superannuation trustees, infrastructure funds — now need Australian-law competition counsel on the inside as well as on a panel. A foreign-qualified M&A specialist without a local certificate cannot sign that advice. In the same Thomson Reuters Institute panel, M&A hours ran minus 2.1 percent, a firm-side reading that does not cancel notification load inside a company.

Capital markets is the cyclical overlay, not the substitute. ASX, in its 16 July 2026 media release and the FY26 listings review dated 24 July 2026, recorded 100 new listed entities in the year to 30 June 2026, up 45 percent from 69 in FY25; IPO capital raised A$5.6 billion; quoted market capitalization of new listings A$32.6 billion; follow-on capital A$37.8 billion; net new capital quoted A$37.1 billion; 23 international listings against 5 in FY25; materials 30 of the new listings. ASIC’s two-year IPO fast-track trial, announced 10 June 2025, was used by 11 issuers in FY26. The Reserve Bank of Australia raised the cash-rate target 25 basis points to 4.35 percent on 5 May 2026, the third hike of 2026, unwinding 2025 cuts. ASX itself recorded the rebound despite higher interest rates. Issuer general counsel and ECM counsel are certificated Australian-law seats. Ashurst, reporting its last full year before combination with Perkins Coie on 23 June 2026, said Australia Corporate Transactions were up 25 percent on a like-for-like basis — a firm-side echo, not a Sydney salary band.

Insolvency and disputes remain a 2026 desk even as the growth rate flattens. ASIC Corporate Insolvency Update Issue 37 (September 2025) recorded 14,722 companies entering external administration for the first time in 2024-25, up 33.2 percent from 11,053 in 2023-24, with a monthly run-rate described as leveling around 1,200 to 1,300. The NSW Supreme Court provisional statistics as at 22 January 2026 recorded Common Law civil filings of 4,041 in calendar 2025 against 3,711 in 2024; Equity Division filings of 4,540 against 4,334; Corporations List filings of 1,329 against 1,174; Possession List filings of 1,786 against 1,632. Common Law five-day hearing listing delay at the start of law term: 5.5 months in 2025 against 4.5 months in 2024. Possession List growth is a banking-enforcement and Crown Solicitor panel seat, not a “corporate” general counsel seat.

FIRB is the continuous constraint underneath the 2026 novelty. Treasury’s 2024-25 annual report recorded 1,362 commercial investment proposals approved, value A$251.5 billion, with 131 commercial withdrawals and no formal prohibition or disposal orders that year. The United States was the largest source, A$122.3 billion from 523 proposals. Of those 1,362 commercial approvals, 109 related to national-security actions (A$4.8 billion) that would not have been captured prior to January 2021. The April-June 2025 quarterly report recorded 326 commercial approvals, value A$49.3 billion. Foreign-buyer deals still need Australian-law advice even when ACCC thresholds are not met.

06 Filling the seat

Time-to-fill follows the certificate, not the shortlist.

We have worked the Sydney in-house market for 5 years. Over the trailing three years we closed 15 in-house searches, at a 93 percent completion rate, on a typical timeline of 4 to 7 months.

Admitted, still supervisedUnsupervised Australian-law seat

  1. Admission and the first certificate Supreme Court admission after an LPAB compliance certificate, then a practicing certificate that still carries Condition 2. Usable in a team. Not usable as sole counsel or as a supervisor.
  2. Condition 2 removed Eighteen months or two years of supervised legal practice, depending on the training path. This is the seniority gate on every unsupervised in-house and principal seat.
  3. The seat a general counsel actually posted Group GC, deputy, sole counsel, solicitor-on-the-record. The search is a search for this column. Everything to the left is a different requisition.

Four of the 9 corporate-certificate files in that closed set stalled at least once on certificate category or Condition 2. Eleven of the 15 completed inside the 4-to-7-month window; 4 reached the seven-month outer bound, each because the preferred candidate was still on a Condition 2 certificate or an Australian registration certificate. Two of those four were re-briefed away from the original Australian-law specification, one onto a foreign-law counsel seat and one onto a legal-operations seat. That is the finding that does not flatter the method: we can close a search and still fail the brief the board signed. Counter-offer incidence on this desk is 26 percent. Median offer-to-acceptance is 12 working days. The certificate check belongs in the first call, not the eighth.

A general counsel at a Sydney-headquartered ADI told us they had pulled a signed offer after the preferred candidate’s certificate was still subject to supervised legal practice. The candidate was otherwise the right seniority and the right regulatory overlay. The statute does not care. In that same Sydney interview cohort, 39 of the 88 in-house general counsel and heads of legal sat in ADI, insurer, superannuation or market-infrastructure legal departments over the same 24-month window; 27 of those 39 named Financial Accountability Regime accountability-map work as part of the live brief. FAR commenced for ADIs on 15 March 2024 and for insurers and RSE licensees on 15 March 2025. Those seats are GC and deputy seats. They are not graduate seats, and they are not ARC seats.

Foreign-law onlyUnsupervised Australian-law GC

  1. Australian registration certificate Foreign-law practice, incidental Australian-law advice only if settled by an authorized Australian legal practitioner. No Group GC, no solicitor-on-the-record, no unsupervised Australian-law seat.
  2. Trans-Tasman admission New Zealand-admitted lawyers apply to the Supreme Court of NSW, not through the ordinary LPAB portal. After admission, a corporate or employee certificate; unsupervised practice still needs Condition 2 removed.
  3. Australian admission plus a clean certificate The column every 2026 Australian-law general counsel, deputy and sole-counsel brief actually occupies. There is no third path that skips it.

Three composites from the same 15-file desk, described by category only. A listed financial-services group needed a Group General Counsel combined with company secretary, FAR-mapped, on a corporate certificate with Condition 2 already removed. The search ran six months. The successful candidate moved from an employee certificate without an immediate variation, then renewed into the corporate category. Completed.

An APRA-regulated superannuation trustee needed a Head of Legal — Investments, Australian-law advice on SIS, Corporations Act, FIRB and ACCC notifications. The search ran five months. The successful candidate was New Zealand-admitted and converted through Trans-Tasman mutual recognition before the offer, not after. Completed. That path exists; it is not a template for a London or New York lateral.

A listed digital-infrastructure issuer briefed a Deputy General Counsel as an Australian-law seat. The preferred candidate held an Australian registration certificate and a foreign practicing title. The file reached the seven-month outer bound and was re-scoped: a foreign-law counsel plus a separately certificated Australian-law senior counsel. We closed a search. We did not fill the original seat. The board paid for two people to do what one certificated deputy would have done in month four.

Thomson Reuters Institute, in the Australian Legal Market Midyear Update issued 23 February 2026, put participating-firm demand at plus 4.8 percent, worked rates at plus 4.7 percent, fees worked at plus 9.8 percent, and lawyer headcount at plus 4.8 percent. Australian general counsel in that panel split net spend anticipation for overall legal work at zero (28 percent increase, 28 percent decrease, 44 percent same) and international legal spend at net plus 14. Direct expenses ran plus 7.3 percent on a rolling 12 months. That is a buyer who is not expanding a panel as a substitute for an internal holder. It is also a buyer who will not thank a search that delivers an uncertificated star.

Your exposure is a certificate that will survive Uniform Law s.10, not a shortlist that looks international.

  • Write two specifications. The legal specification and the certificate specification. Confusing them produces a role nobody admitted in this jurisdiction can occupy.
  • Ask the category in the first call. Corporate, employee, government, principal; Condition 2 on or off; Australian registration certificate or Australian practicing certificate. Four questions save two months.
  • Price the public book separately. The Crown award and the Law Society survey measure different products. Do not brief a bank general counsel on a Legal Officer scale, or a Crown seat on a corporate survey average.
  • Budget the counter-offer. Employers defend certificated unsupervised counsel because replacement is another 4-to-7-month clock, not another two-week shortlist.
  • Do not gold-plate a policy seat. If the work is operations or policy, hire it as that. Attaching a certificate you do not need shrinks the pool and raises the price without buying advice you can privilege.

Your certificate is the asset the offer is written on. Titles you used overseas are not a substitute.

  • Know your own category. Which Uniform Law s.47 category you hold, whether Condition 2 remains, and the date you can have it removed. Employers who ask early are running a real process.
  • Do not audition for Group GC on an ARC. Foreign-law desks are real work. They are not the seat, and treating them as a stepping stone without an admission plan is how files die at month seven.
  • New Zealand admission is the exception that is measured. If you are not on that path, budget assessment, admission and supervised practice in years, not in the offer-to-start window.
  • Read the survey from the earning side. On the Law Society figures in the pay section, the corporate book is not an automatic discount to private practice, and it is not an automatic raise. Large-firm private practice still owns the far tail.
  • If you want the combined GC and company secretary seat, treat it as a governance skill sitting on a corporate certificate. Privilege follows legal practice, not the board-minutes title.

Questions a general counsel, and the lawyer they are hiring, actually ask

What does the legal market Sydney require of an in-house hire in 2026?

A current Australian practicing certificate: NSW in-house practice without one ended on 1 July 2018. Uniform Law s.10 prohibits unqualified legal practice, including inside a company. A sole in-house lawyer, or anyone who will supervise others, also needs Condition 2 (supervised legal practice) removed. A foreign-law registration certificate does not substitute. Policy and legal-operations seats can sit outside that gate; the moment the occupant gives Australian-law advice, the gate closes.

What does a Sydney in-house lawyer earn against private practice and government?

Corporate respondents averaged A$235,439 in FY2023-24 on the Law Society of New South Wales 2025-26 Practising Certificate Survey, against A$194,987 in private practice and A$152,978 in government. Among full-time and part-time respondents, 45 percent of corporate lawyers reported more than A$200,000, versus 27 percent of private practice and 11 percent of government. That is self-reported gross income from 15,464 survey respondents (a 38 percent response), not an employer payroll file. NSW government Legal Officer Grade VI, on the Crown Employees award, sits at A$170,841 to A$174,440 from 1 July 2026 — below the corporate survey average, which is why a public-to-private in-house move is a pay conversation as well as a credential one.

Can a foreign-qualified lawyer fill a Sydney general counsel seat?

Not as Australian-law counsel: Uniform Law s.60 caps casual foreign-law practice at 90 days in any 12 months. An Australian registration certificate authorizes foreign law; it does not authorize Australian-law advice except where that advice is necessarily incidental and expressly based on an Australian legal practitioner who is not the holder’s employee. New Zealand-admitted lawyers are the exception that is measured: the Legal Profession Admission Board recorded 105 Trans-Tasman admissions in NSW in 2024-25, against 2,957 total admissions. Everyone else plans in years of assessment, admission and supervised practice, not in weeks.

How long does a Sydney in-house search take once the certificate is in order?

Typically 4 to 7 months on Sartori’s Sydney in-house desk, with a median 12 working days from offer to signature. We have worked this market for 5 years. Of 15 closed in-house searches over the trailing three years, the files that ran long did so on certificate category or Condition 2, not on a thin shortlist. Counter-offer incidence on this desk is 26 percent. Completion runs at 93 percent.

Which 2026 rules are actually creating Sydney legal seats?

From 1 January 2026 the ACCC’s mandatory merger regime produced 50 notifications and 108 waiver applications in the first quarter. Overlay, with a seat attached to each: Financial Accountability Regime maps at insurers and superannuation trustees from 15 March 2025; Legal Services Directions 2025 from 2 March 2026 for Commonwealth tied work; AML/CTF tranche-two enrolment from 31 March 2026 and obligations from 1 July 2026; ransomware-payment reporting in an enforcement posture from 1 January 2026; the statutory privacy tort from 10 June 2025. None of those instruments lets a general counsel fill an Australian-law seat without the local certificate.

Does a legal-operations or company-secretary hire need a practicing certificate in Sydney?

Not if the seat is policy or operations only: Uniform Law s.6 excludes policy work from engaging in legal practice. Company-secretarial work that is minutes, lodgements and board process is not automatically legal practice. Combined general counsel and company secretary seats at listed Sydney companies are still filled by admitted, certificated solicitors, because those occupants give legal advice. The Association of Corporate Counsel 2024 in-house trends report put the company-secretary overlap at 49 percent of Australian chief legal officer respondents. Privilege attaches to legal practice, not to the secretarial title.

Law Society census, Uniform Law, dockets and the award

The public stock is a regulator census. The pay is a voluntary survey. The clocks are statutes. The calendar is our mandate file.

Sartori & Partners runs a continuous research program over its own records: nearly 1.5 million lawyer profiles mapped globally, tens of thousands of structured candidate and client interviews, thousands of mandate and process records, and quarterly market surveys running since 2019. The Sydney in-house desk is 5 years in this market; the interview cohort, the closed-search count, the counter-offer rate and the offer-to-acceptance window on this page are Sartori & Partners figures for the Sydney in-house desk.

Practicing-certificate counts are persons holding a current NSW solicitor certificate on one census date, not unique employers and not FTE. Income figures are self-reported gross annual income among survey respondents, not a mandatory census and not employer-paid base salary. FIRB approvals are proposals approved, not completed deals. ACCC notifications are filings under the new mandatory regime, not a headcount of competition lawyers hired. Thomson Reuters Institute percentages are a participating-firm panel, Australia-wide. Award dollars are base salary for named NSW legal-officer grades. Engagement narratives are anonymized composites from the 15-file desk, described by employer type and certificate category only.

Filling a certificated in-house seat in Sydney?

We map in-house legal talent in Sydney, and we are as willing to tell a general counsel that a requisition is written for a certificate nobody holds as to open a search. Confidential, no obligation.
