Tax Attorney Salary 2026 (US): Law Firm vs In-House
There is no official 2026 census of US tax attorneys, and no publisher counts the in-house tax seats companies are trying to fill. The dated bands a tax associate earns and a general counsel funds are lockstep, in-house Legal, and GS-15.
The 2026 market does not employ a number you can Google.
Sartori maps roughly 67,000 lawyers in New York. There is still no official count of how many US lawyers practice tax, and no publisher counts the in-house tax seats companies are trying to fill. The dated pay table comes after that fact, because a general counsel who prices the wrong desk is not short of a salary survey.
The Occupational Outlook Handbook, accessed 11 September 2026, reports 863,700 lawyer jobs in 2025 and a May 2025 median wage of $159,670. Tax is a duty set, not a SOC. Do not treat 863,700 as a tax headcount.
A general counsel who needs a number for the board gets bands, not a census. The dated pay table is the next honest object.
- $43,700
- Upper user fee for an IRS private letter ruling, with 2,571 PLRs issued in the three years to 1 February 2026.
- NYU Tax Law Center, updated 1 February 2026
- 271.4M
- Returns and other forms the IRS processed in FY2025, up 1.8 percent from FY2024.
- IRS Data Book 2025 (Publication 55B, April 2026)
- ~690
- Federal government jobs excluding clerkships for the Class of 2025, down 37.0 percent from nearly 1,100.
- NALP Class of 2025 Selected Findings, 5 August 2026
That New York mapping file is what makes a tax-associate shortlist tractable. It does not invent a national tax-attorney census, and it does not record who holds a tax LL.M. or who practices before the IRS under Circular 230.
BLS industry mix for all lawyers in 2025 is the closest official geography of where tax work can sit: legal services 52 percent, self-employed 11 percent, local government 8 percent, state government 7 percent, federal government 5 percent. May 2025 industry medians were $178,380 in the federal government and $157,870 in legal services. The 10th percentile across all lawyers was $78,360; the 90th was $351,600. None of those cuts is a tax-attorney wage. They are why a general counsel cannot take the Occupational Outlook Handbook to the compensation committee and call it a tax band.
There is no official 2026 census of US tax attorneys.
The 2026 tax attorney salary table is three columns, not one.
Lockstep base is a class-year ladder. In-house Legal is a title median. Federal tax counsel is a General Schedule locality band. Adding them produces a sentence that is not true of any desk.
On 2 June 2026, Bloomberg Law reported that Milbank raised associate base salaries by $10,000 to $20,000 by seniority, taking the scale to $235,000 through $455,000, and that McDermott matched. Above the Law the same day put the effective date at 1 July 2026 and included summer associates. Biglaw Investor, accessed 11 September 2026, tabulates the class-year bases as $235,000, $245,000, $270,000, $320,000, $385,000, $410,000, $440,000 and $455,000. That ladder is what a tax associate earns at a matching firm. It is not a tax-only scale, and it is not what a chief legal officer pays a Tax Counsel who reports inside Legal.
Bonus cash is a different vintage. Cravath set the last published year-end and special grid on 18 November 2025, reproduced by the ABA Journal on 19 November 2025: $15,000 year-end plus $6,000 special for the then-junior class, rising to $115,000 plus $25,000 at the senior end, a combined senior bonus of $140,000. Law.com the same week confirmed Cadwalader, Paul Hastings and McDermott followed. 2026 year-end bonuses had not been announced as of 11 September 2026. The table below keeps the vintages in separate columns. It does not mint a 2026 all-in by adding a 2025 bonus to a 2026 base.
| Seniority | 2026 base | 2025 year-end | 2025 special |
|---|---|---|---|
| 1st year | $235,000 | $15,000 | $6,000 |
| 2nd year | $245,000 | $20,000 | $6,000 |
| 3rd year | $270,000 | $30,000 | $10,000 |
| 4th year | $320,000 | $57,500 | $15,000 |
| 5th year | $385,000 | $75,000 | $20,000 |
| 6th year | $410,000 | $90,000 | $25,000 |
| 7th year | $440,000 | $105,000 | $25,000 |
| 8th year & senior | $455,000 | $115,000 | $25,000 |
Class-year bases are the 2026 market scale at matching firms. Bonus columns are the November 2025 Cravath grid for the then-sitting classes. They are not a 2026 year-end announcement.
Median first-year base, firms of 250 or fewer
NALP Associate Salary Survey as of 1 January 2025. Overall first-year median was $200,000.
NALP, June 2025 Bulletin+ ↗A candidate searching tax lawyer salary and a general counsel pricing a requisition are not looking at the same object. The lockstep ladder above is class-year cash at matching firms. The in-house medians in the short version are ACC titles. The axis just above is the first-year market as it stood on 1 January 2025, before the raise. NALP’s Class of 2025 Selected Findings, dated 5 August 2026, are a third cut: a national median salary of $100,000 as of 16 March 2026, a private-practice median of $155,000, a median of $225,000 in firms of more than 500 lawyers and $84,000 in firms of 1 to 10, with 34.4 percent of reported law-firm salaries at $225,000. No public NALP table splits tax practice from other practices.
The geometry a chief legal officer has to sit with is simple. The 2026 lockstep first-year base sits above the 2025 in-house Senior Attorney median. A company that wants a lockstep tax associate to step into Legal is not haggling inside the ACC title band. It is asking that lawyer to take a cash cut against a ladder that just moved. The inverse is also true: a first-year on the Milbank scale is not a GS-15 Senior Counsel, and quoting OPM at a New York associate is not a market read.
Three desks buy tax work. Only two of them are lawyer seats.
Firm Tax sits on the deal. Legal-side tax counsel reports to the general counsel. The larger in-house tax population reports to Finance and is not, as a class, a JD roster.
A law-firm practice groupA Finance tax department
- Firm Tax Nested inside M&A, private equity, capital markets, funds and real estate, with a separate controversy pod. The paycheck is class-year cash at matching firms.
- Legal-side tax counsel Tax Counsel or AGC-Tax reporting to the general counsel or chief legal officer. This is the attorney seat a company legal department actually owns.
- Finance-side tax Head of Tax, Chief Tax Officer, Director of Tax under the CFO. TEI’s membership is built for this desk, and it is not a lawyer-only roster.
Firm announcements in the first two weeks of September 2026 still staff Tax as a deal practice. An Am Law 20 global firm’s 2 September 2026 New York notice put a co-head of Tax on M&A, joint ventures, spinoffs, financial instruments, public-company and private-equity work, and stated the practice includes more than 60 tax lawyers across the United States and Europe. An Am Law 10 firm’s Tax group page, accessed 11 September 2026, states more than 140 attorneys in nine offices, with tabs for energy-credit monetization, income tax and accounting, international tax, Opportunity Zones, REITs, SALT, and tax controversy. A 9 September 2026 New York announcement at an Am Law 50 firm placed the incoming tax partner inside the Transactional Department, not a free-standing boutique. The buyer on those pages is the deal. The paycheck is the lockstep table above.
The labels a company should copy, if it copies anything, are the ones those pages actually use. Jones Day’s Tax practice page, accessed 11 September 2026, lists M&A tax, private equity and fund formation, real estate tax and REITs, state and local tax, tax controversy and litigation, tax credits and incentives, tax planning and international tax, exempt organizations, banking and finance tax, and bankruptcy and insolvency tax as separate product lines, and it posted a Washington tax-controversy hire in August 2026. Davis Polk’s Tax page puts transactional planning, financial products, real-estate structures, restructuring tax, controversy and a separate tax-policy offering on the same platform. Kirkland’s Tax Disputes group sits in Litigation, not Tax, and lists IRS exam, Appeals, MAP, Tax Court, the Court of Federal Claims, and partnership issues under TEFRA and the BBA. A Washington tax boutique still staffs Circular 230 and Office of Professional Responsibility defense as its own mandate. A general counsel who writes “tax lawyer” on a requisition has not chosen among those desks.
The company-side split is the one a general counsel actually has to manage. TEI’s Join page is explicit: full membership is for in-house tax professionals including accounting, finance, tax technology and unclaimed property. Morgan Lewis’s Tax practice page, accessed 11 September 2026, says its tax lawyers “partner with our clients’ in-house tax personnel” — a sentence that treats the company tax department as a counterpart, not as a legal department. ACC’s 2025 Law Department Compensation Survey is the lawyer-side book: Attorney, Senior Attorney, Expert Attorney, Managing Attorney, Associate General Counsel, Deputy GC, GC/CLO. Tax appears there as a specialty cut. It does not appear as a printed dollar.
Of 38 in-house tax-lawyer respondents inside Sartori’s New York interview cohort, over a 24-month window, 22 said the tax seat reports to Finance or the CFO, not to Legal. A chief legal officer who writes “reports to GC” onto a Head of Tax requisition has not described the job the incumbent holds. A head of HR who copies an ACC Attorney median onto a Finance-side Director of Tax seat has not described the job TEI was built for.
| Desk | Reports to | Titles in 2026 materials | What the pay table prices |
|---|---|---|---|
| Lockstep firm Tax | Practice group, often inside the transactional department | Tax associate, tax counsel, tax partner | Class-year cash at firms that match the Milbank scale |
| Legal-side tax counsel | General counsel / chief legal officer | Tax Counsel, AGC-Tax, Counsel (Tax) | An attorney seat. ACC prints title medians, not a tax-specialty dollar |
| Finance-side tax | CFO / Head of Tax | Head of Tax, Chief Tax Officer, Director of Tax | An in-house tax professional. TEI membership is not a lawyer roster |
Public-body buyers sit on a fourth payroll, and they are not a rounding error in 2026. IRM 1.1.1, transmitted 10 July 2025, states that Chief Counsel provides legal interpretation and represents the IRS, reporting to the Commissioner on tax matters and to the Treasury General Counsel on other matters. Treasury’s Office of Tax Policy page names the Tax Legislative Counsel, International Tax Counsel and Benefits Tax Counsel as the attorney offices that review regulations and rulings. The United States Tax Court Law Clerk Program, accessed 11 September 2026, starts typical clerks at GS-11, requires a law-school graduate, and prefers federal tax courses; a bar is not required at appointment but must be passed within 14 months. Bloomberg Tax on 16 June 2025 reported the DOJ Tax Division had about 390 attorneys and 503 employees in 2024; the FY2026 request eliminates the division as a component and realigns civil work to Civil and criminal work to Criminal. A general counsel hiring from that pipeline is not hiring from the Milbank scale. They are hiring from a GS table and a 2025 hiring pause that USAJOBS Chief Counsel postings themselves describe.
Of 38 in-house tax-lawyer respondents, 22 said the seat reports to Finance, not to Legal.
The associate line closes. The tax cut is where the brief breaks.
Sartori has worked the New York market for more than 10 years. Over the trailing three years the associate line closed 33 searches at a 93 percent completion rate, on a typical 6-to-12-week clock, with a median 11 working days from offer to signature.
Counter-offer incidence on that New York associate line is 37 percent. Of the 33 closed associate searches, 9 were tax-practice associate seats. 7 of those 9 completed. 3 of the 9 drew a counter-offer, in line with the line-wide 37 percent. Two files did not complete: in both, a company brief and a firm brief had been stapled together. One side was hiring a Legal-side tax counsel. The other was hiring a Finance-side tax professional. Sartori sent the specification back. Both clocks ran past 12 weeks. The associate line’s 93 percent completion rate did not hold inside that tax cut.
A general counsel at a US-listed industrials group told us Finance had posted the tax-counsel seat without showing Legal the band. The chief legal officer saw the requisition after a compensation committee had already anchored to an ACC Attorney median. By the time Legal rewrote the reporting line, the first shortlist had gone cold. That is not a talent shortage. That is an ownership fight priced as a salary.
Of the same New York interview cohort, 112 tax-practice respondents sat in a 24-month window: 61 at law-firm Tax (associate or counsel), 38 in-house tax lawyers, 13 from government tax seats. Of those 61 firm-side lawyers, 47 said 2026 cash tracks class year at a matching firm, not a tax-practice premium. Tax does not get a lockstep uplift because the Code is dense. It gets the same $235,000-to-$455,000 ladder the corporate associate gets. Of the 38 in-house tax-lawyer respondents, 29 said their last cash package sat below the fifth-year lockstep base then in force at matching firms. A fifth-year tax associate at an Am Law 50 New York practice told us the June 2026 raise did not change the in-house conversation: the company still opened below fifth-year base and called the gap “the lifestyle discount.”
Quarterly surveys running since 2019, against a global mapping of nearly 1.5 million lawyer profiles, keep returning the same company-side pattern in New York: the person who signs the offer is often not the person who wrote the Code-skill list. That is why a tax-associate search that looks ordinary on the lockstep line becomes a 12-week stall once a Head of Tax and a general counsel both think they own the hire. We cannot see, in our own mapping, which New York lawyers hold a tax LL.M. or an IRS practice authorization under Circular 230. Those gates live on licenses and transcripts. Treating the mapping file as a tax-credential census would flatter the desk. It would also be false.
One statute rewrote the work. The staffing cut rewrote who is across the table.
Public Law 119-21, signed 4 July 2025, is the 2026 demand shock. TIGTA measured IRS separations are the supply shock on the government side. Neither is a reason to invent a vacancy census.
H.R. 1 was signed on 4 July 2025 as Public Law 119-21. IRS Publication 6144 (Rev. 4-2026) states the Service is using phased implementation: no changes to Form W-2 or federal withholding tables for tax year 2025, with Form W-4 updated for tax year 2026. Tax Foundation’s FAQ, updated 10 December 2025, estimates the modeled tax provisions reduce federal revenues by $5.0 trillion over 2025–2034 and increase the deficit by $3 trillion over the decade after spending cuts and growth. Permanence of the 2017 individual rates is most of the tax-cut value: the 10–37 percent ordinary rates stay, rather than reverting to a 39.6 percent top rate, with a larger standard deduction enhanced to $15,750 single / $31,500 joint in 2025. Temporary 2025–2028 deductions cover qualified tips, overtime premium, auto-loan interest, and a $6,000 senior deduction. The SALT cap is listed by IRS as a changed provision; Tax Foundation states the $40,000 SALT cap reverts to $10,000 in 2030. For a general counsel, the hiring consequence is not a first-year generalist. It is mid-to-senior federal, international and SALT counsel who can model NCTI and FDDEI for years beginning after 31 December 2025, take a §174A methods change, and still close a deal-tax memo on the live M&A calendar. SALT work through 2029 is a mid-senior file, not a one-year spike.
Domestic R&E expensing returned as §174A. The IRS newsroom hub, accessed 11 September 2026, states that for taxable years beginning after 31 December 2024 taxpayers may currently deduct domestic research or experimental expenditures, or elect amortization over 60 months or more; foreign R&E remains on 15-year amortization. Rev. Proc. 2025-28, released 28 August 2025, gives automatic-consent procedures for method changes under §§174 and 174A. That is in-house federal tax and accounting-methods counsel at four to ten years, concentrated through the 2026 filing season. It is not a junior compliance pipeline.
Treasury and IRS released the 2025–2026 Priority Guidance Plan on 30 September 2025 with 105 projects, of which 40 are labeled One, Big, Beautiful Bill Act implementation, against 231 projects on the 2024–2025 plan. Forty-six of the 105 sit under deregulation and burden reduction. The plan is jointly signed by the Assistant Secretary for Tax Policy, who also signed as Acting Chief Counsel. That dual-hatting is a guidance-independence issue, not a headcount. It is also a signal to in-house international tax counsel that the 2026 comment calendar is concentrated, not broad: Grant Thornton’s 18 December 2025 guide describes NCTI and FDDEI replacing GILTI and FDII, a 40 percent NCTI deduction and a 33.34 percent FDDEI deduction, and a BEAT rate of 10.5 percent. Proposed §250 regulations in the Federal Register of 20 August 2026 set comments due 5 October 2026.
TIGTA Report 2026-IE-R009, dated 9 June 2026, measured 31,273 IRS employees who separated, took a deferred-resignation program, or used another incentive between January 2025 and January 2026, about 30 percent of the workforce, a net decrease of about 28 percent after roughly 2,000 hires. About 33 percent of revenue agents and 32 percent of tax examiners left. Of more than 21,000 DRP-approved employees, 1,262 were offered a chance to return; 422 returned. Between September 2025 and 10 January 2026 the Service hired 2,287 people into Taxpayer Services — 2,238 contact representatives and 49 tax examiners, not Counsel attorneys. One hundred forty-two members of the Senior Executive Service, about 46 percent, left. The agency had seven Commissioners during 2025. Thomson Reuters Checkpoint, on 10 October 2025, reported that IRS furloughed more than 34,000 employees, about 54 percent of the remaining workforce, during the October 2025 appropriations lapse, while the contingency plan kept 2026 filing-season and OBBBA implementation on the continue list. USAJOBS 2026 Chief Counsel postings describe a 2025 hiring pause and a 2026 reopen. The Class of 2025 federal-hiring crash is why Honors was thinner. The private tax groups at large firms absorbed some of that cohort as general tax associates. They did not absorb them as GS-15 Senior Counsel.
The Data Book’s attorney FTE line does not rescue the headcount story. Table 6-3 reports FTE attorneys of 1,826 in FY2024 and 1,875 in FY2025. Pay-status attorney headcount fell. FTE used rose. The same table notes the drop in employees in pay status was mainly due to the OPM and Treasury deferred-resignation programs, VERA and VSIP, in effect on or before 30 September 2025. A general counsel reading only FTE would think Counsel got denser. A general counsel reading pay-status and the National Taxpayer Advocate table would not.
TIGTA Report 2026-IE-R003, dated 25 March 2026, tracked Inflation Reduction Act IRS funding from about $79.4 billion at 2022 enactment to $26 billion remaining through 30 September 2031 after rescissions totaling $53.5 billion. IRS Publication 4450 (Rev. 4-2026) puts the FY2027 request at $9.8 billion, 12.2 percent below the FY2026 enacted $11.2 billion, and states IRA funding is expected to be exhausted in FY2028. Fewer examination, Appeals and Counsel FTEs means more of the published-guidance and controversy work lands on company tax departments and on the firms those departments already panel. That is a 2025–2028 structural cut, not a one-quarter freeze. It is also not a published count of open in-house tax-attorney requisitions.
Opportunity Zones were made permanent under the same statute. The IRS newsroom hub describes the qualified opportunity-zone program as continuing, with a rural-area definition and, beginning 4 July 2025, a substantial-improvement threshold reduced from 100 percent to 50 percent for property entirely in rural QOZs. That is a funds and real-estate tax label at firms that already staff it, not a new profession.
Two dated clocks sit on top of that cut. IRS Notice 2025-42, released 15 August 2025, supplies beginning-of-construction rules for the OBBBA wind and solar termination under §§45Y and 48E: facilities generally need to begin construction on or before 4 July 2026 to keep the credit after the 31 December 2027 placed-in-service cutoff. That is energy-tax and tax-credit-monetization work at counsel-to-partner seniority through the deadline, then qualification, recapture and controversy after it. Separately, Fenwick (3 September 2026) and Alston & Bird (23 July 2026) describe Siemens Medical Solutions USA Inc. v. Commissioner, 167 T.C. No. 5 (15 July 2026), a 17–0 Tax Court reviewed opinion, and Keysight Technologies, Inc. v. United States, No. 25-137 (Fed. Cl. 2 July 2026), as Loper Bright applications that struck TCJA-era Treasury regulations. Bloomberg Tax on 15 July 2026 reported the Keysight opinion as a threat to Treasury’s use of §7805(a). That is senior controversy, not a first-year lockstep driver. The disputes thesis belongs on the controversy page. The pay consequence here is narrower: the company that needs a regulation-validity brief is not priced off the ACC Attorney median.
The deal calendar still pays the transactional desk. Wells Fargo’s January 2026 M&A Market Pulse, citing LSEG/PitchBook as of 31 December 2025, put US announced M&A at $2.3 trillion, up 57 percent year over year, on a deal count of 12,007, down 11 percent from 2024; deals above $5 billion were 59 percent of volume. US sponsor activity was $1.2 trillion, up 70 percent, across 6,229 deals, down 10 percent. EY-Parthenon on 2 June 2026 forecast 8 percent growth in 2026 US deal volume for transactions above $100 million, with corporate M&A up 11 percent and private-equity volume flat. A general counsel staffing tax for 2026 should staff transactional tax against large-cap value, not against 2025’s deal count, and should not staff a PE-tax seat as if 2026 volume will reprint 2025. Pillar Two is not enacted in the United States. Treasury’s 28 June 2025 G7 release and EY’s 16 January 2026 alert on the 5 January 2026 Inclusive Framework package describe a side-by-side safe harbor that keeps QDMTT and GloBE Information Returns in force for electing US-parented groups. That is still an in-house international-tax file. It is not a new junior seat title.
Throughput at the Service did not fall with headcount in lockstep. The IRS Data Book 2025 (April 2026) reports FY2025 gross collections of $5.3 trillion and 497,621 tax-return audits closed with $26.8 billion of recommended additional tax. Chief Counsel received 48,544 cases and closed 47,575 in FY2025; 21,406 Tax Court cases were pending (excluding appeals) on 30 September 2025 with $53.057 billion in dispute. A thinner Counsel bench sitting on that docket is why experienced controversy associates who would have gone to Honors or DOJ Tax in a normal cycle stayed in private practice in 2025–2026. It is not a reason to quote Am Law 100 profits per equity partner — $3.59 million, up 14.0 percent in calendar 2025, on $178.95 billion of aggregate gross revenue, as Original Jurisdiction reported on 30 April 2026 citing the 2026 Am Law 100 — as a tax-partner paycheck. Those are firm-wide economics. They do not isolate tax-practice revenue.
Price the seat you are hiring, not the title you copied.
A tax associate reads the lockstep ladder. A general counsel has to decide which of the three desks is on the requisition before any number is defensible.
Copy a firm ladderPost a General Schedule band
- Match lockstep Only if the seat is a law-firm tax associate at a matching firm, or a company is deliberately buying a lockstep lawyer into Legal and has budgeted the cash cut the other way.
- Match an ACC title Only if the seat is a lawyer reporting to the general counsel. Attorney and Senior Attorney are the printed medians. Tax is not a printed dollar.
- Post the GS band Only if the seat is Chief Counsel, Treasury Tax Policy, Tax Court chambers, or the remaining DOJ tax-enforcement functions. Locality tables, not lockstep.
A tax associate is paid by class year at matching firms. A federal tax attorney is paid by grade and locality. An in-house tax lawyer is paid by title, not by a published tax-specialty median.
- Class-year credit is the lockstep lever. A lateral who loses a year on the 2026 scale loses the $235,000-to-$455,000 step that year is worth. Ask the question before the offer letter, not after.
- A tax LL.M. is not a second license. NYU’s Graduate Tax FAQ is explicit: a JD from an ABA-accredited school already satisfies bar-education requirements. Georgetown’s online Taxation LL.M. will not lead to professional licensure and will not qualify a student to sit for any state bar. The degree is a preference. Tax Court notes that some judges prefer it. IRS Honors has historically appointed LL.M. candidates at GS-12 and JD candidates at GS-11. It does not replace the bar.
- Circular 230 is the practice-before-IRS gate for attorneys, CPAs and enrolled agents, administered by the Office of Professional Responsibility. It is not a salary scale.
- Government cash is a locality table. Tax Court clerks typically start at GS-11. OPM’s 2026 Washington-Baltimore table posts GS-11 at $85,447 to $111,087. Chief Counsel Senior Counsel postings in 2026 used GS-15. Honors is the only path for new attorneys into Chief Counsel, with a three-year commitment. The 2025 federal hiring crash is why that path was thinner for the Class of 2025.
A general counsel, chief legal officer or head of HR prices a lawyer seat. A CFO prices a tax department. Writing one requisition for both is how the New York tax files stalled.
- Name the reporting line first. If the person reports to the chief legal officer, you are in the ACC book. If they report to the CFO, you are in the TEI book. ACC’s 2025 survey found an Attorney with prior law-firm experience at a median base 16 percent higher and total cash 18 percent higher than peers without firm experience. That premium is how a company buys lockstep fluency into Legal. It is not a reason to match the eighth-year lockstep base.
- Do not write “tax lawyer” on the requisition. The 2025–2026 materials actually staff M&A and transactional tax, private-equity and funds tax, REIT and real-estate tax, SALT, energy-credit monetization, international tax (NCTI, FDDEI, BEAT, FTC), and controversy. A generic label is how a Head of Tax and a general counsel each think they have commissioned the same hire.
- Budget the New York associate clock. Six to 12 weeks on the line; 11 working days from offer to signature; 37 percent counter-offer incidence. The tax files that blew past 12 weeks were the ones where ownership of the seat was still in dispute.
- Under-resourced is not permission to under-price. The Thomson Reuters/TEI survey is a department-capacity finding. It does not tell a chief legal officer what to put in the offer letter.
Two anonymized composites from the New York associate book, inside the same 33 closed searches. A PE-backed healthcare platform asked us to take a fifth-year tax associate off an Am Law 50 New York practice into a newly created Tax Counsel seat reporting to the general counsel, with a dotted line to a Finance Head of Tax. The brief named NCTI modeling and a live fund-structure calendar. We closed it in eight weeks. The matching-firm fifth-year base was the negotiation floor; the company did not match it and did not pretend to. The candidate signed in 11 working days. No counter-offer landed. The specification had one owner.
A US-listed technology group sent the opposite brief: “tax lawyer, six to eight years, either in-house or firm,” reporting line blank, band copied from an ACC Senior Attorney median. Finance thought it was replacing a Director of Tax. Legal thought it was adding AGC-Tax. The first nine approaches went to lockstep tax associates who declined a first meeting at that cash. The tenth went to an in-house tax manager who was not a member of any bar. We stopped the process at week 14 and asked the general counsel and the CFO to pick a desk. That file is one of the two tax-associate mandates that did not complete. A company that has not decided whether it is hiring a lawyer is not ready to talk about tax counsel salary.
What a single number on a requisition hides.
Comparing a lockstep base to an in-house median is the mistake companies make when they want one figure for the board. The board already has three desks.
Hours, bonus eligibility and equity sit outside the lockstep columns, the ACC medians and the GS locality bands. ACC reports total cash as well as base; lockstep firms gate some of the bonus behind hours; federal locality pay is capped at Executive Level IV, which is why both the Washington and New York GS-15 bands stop at $197,200. A general counsel who needs a private read on a live requisition — which desk, which band, which credential gate — starts with in-house counsel recruiting or, where the seat is still a firm tax associate, associate recruiting. Incumbents who will not move are a different problem, mapped on tax-lawyer mobility. The 2026 number a company actually has is a desk, not a census.
BLS, the IRS Data Book, OPM, ACC, NALP, and the 2026 lockstep announcements.
Lockstep bases are the Milbank scale effective 1 July 2026. Bonus columns are the Cravath grid announced 18 November 2025. ACC medians are 2025 title medians, not a published tax-specialty dollar. IRS attorney counts measure pay-status personnel, not a national tax-attorney census.

BLS SOC 23-1011 measures all lawyers. ABA Tax Section membership includes students. TEI membership includes non-attorney in-house tax professionals worldwide. Thomson Reuters/TEI 58 percent is a department survey, not a vacancy census. Am Law 100 PEP and revenue are firm-wide and do not isolate tax-practice economics. 2026 year-end bonuses had not been announced as of 11 September 2026.

What is the tax attorney salary at lockstep firms versus in-house in 2026?
Bloomberg Law reported on 2 June 2026 that matching-firm base now runs $235,000 to $455,000. ACC’s 16 September 2025 survey of 1,632 US in-house lawyers puts Attorney median base at $148,000 and Senior Attorney at $201,000. Those are different desks. A company that copies the lockstep first-year onto an in-house tax-counsel requisition is not pricing the seat it is hiring. 2026 year-end bonuses had not been announced as of 11 September 2026; the last published Cravath grid is 18 November 2025.
How many US tax attorneys are there in 2026?
There is no official 2026 census: BLS counted 863,700 lawyer jobs in 2025 and does not split tax. Measured bands sit elsewhere. IRS attorneys in pay status were 1,668 on 30 September 2025 (Data Book 2025, April 2026). The ABA Section of Taxation served more than 11,000 members as of a 10 September 2025 announcement, including students. TEI reports more than 6,500 in-house tax professionals at more than 2,800 companies worldwide — not attorneys only, not United States only. No publisher counts open in-house tax-attorney seats.
What does in house tax counsel actually earn next to lockstep cash?
ACC’s 16 September 2025 Executive Summary puts in-house Attorney median base at $148,000 (total cash $160,000) and Senior Attorney at $201,000 (total cash $228,000). An Attorney with prior law-firm experience shows a median base 16 percent higher and total cash 18 percent higher than peers without firm experience. The survey ranks Tax among specialties and does not print a tax-specialty dollar. That number is omitted here.
What is the 2026 GS-15 band for federal tax counsel in Washington?
OPM’s 2026 Washington-Baltimore table posts GS-15 locality pay at $169,279 to $197,200. USAJOBS IRS Chief Counsel Senior Counsel and Special Counsel postings in 2026 use that same GS-15 band, with a gate of one year of general legal experience plus three years of professional legal tax experience. New York-Newark GS-15 runs $174,347 to the same $197,200 Executive Level IV cap. This is General Schedule cash, not lockstep and not ACC.
Should a general counsel hire tax counsel into Legal or leave the seat in Finance?
Decide the reporting line before you price the seat: of 38 in-house tax-lawyer respondents in Sartori’s New York cohort, 22 said the seat reports to Finance. A Head of Tax under the CFO is the TEI desk. Tax Counsel or AGC-Tax under the chief legal officer is the ACC desk. Mixing them on one requisition is how two of nine New York tax-associate files in our mandate book stalled past the 12-week window. Controversy and transfer-pricing disputes are a different hire, mapped on the controversy demand page.
How long does a New York tax-associate search take, and what does tax counsel salary depend on?
Budget 6 to 12 weeks on Sartori’s New York associate line; two of nine tax files ran past that window. Median offer-to-signature is 11 working days once a candidate is in play. Counter-offer incidence on that line is 37 percent. Tax counsel salary on the company side then depends on whether Legal or Finance owns the seat, not on a published tax-specialty median — ACC did not print one in 2025.

A general counsel, chief legal officer or head of HR who needs a tax attorney on the payroll gets a desk, a band and a credential gate — not a national average. We have worked New York for more than ten years. No name circulated.
