›Energy tax credit lawyer recruiter

An energy tax credit lawyer recruiter fills partner, counsel, and in-house seats that price, transfer, and defend production and investment credits. Public Law 117-169 (August 16, 2022) added section 6418. Treasury Decision 9993 took effect on July 1, 2024. Public Law 119-21 (July 4, 2025) ends the section 45Y and 48E credits for wind and solar placed in service after December 31, 2027 if construction starts after July 4, 2026. Sartori & Partners has run 11 tax-credit and incentives searches since 2023. A NYSE-listed independent power producer in Houston hired tax counsel for credit transfers in 12 weeks in 2025.

An energy tax credit lawyer recruiter is retained when the hire has to close a credit. The work started as a financing specialty and became a transfer market on a fixed date. Section 6418, added by Public Law 117-169, 136 Stat. 1818 (August 16, 2022), lets an eligible taxpayer elect to transfer specified credits to an unrelated buyer. Treasury Decision 9993, published in the Federal Register on April 30, 2024, is effective July 1, 2024. Those final regulations cover the election, partnership and S corporation transfers, excessive credit transfer, recapture, and the IRS pre-filing registration.

Registration showed up in the portal before the final rules took effect. On March 8, 2024, the Treasury Department reported more than 45,500 facilities or projects requesting registration numbers through IRS Energy Credits Online, and more than 98 percent of them were pursuing transferability. More than 80 percent were under the section 48 investment credit, and more than 15 percent were under the section 45 production credit. The same release covers elective pay on that portal. Source: Treasury press release, March 2024.

The generation pipeline behind those registrations is still large. The Energy Information Administration, in its February 2026 Today in Energy note, expected 86 GW of planned new U.S. utility-scale generating capacity in 2026, a record if the pipeline is realized, with 51 percent of it solar. Source: EIA, February 2026. How that pipeline turns into partner and associate hiring is the subject of whether energy-transition law is hiring in 2026.

Sartori & Partners has run 11 tax-credit and incentives searches since 2023. 7 were for law firms and 4 were for companies. 8 of the 11 were energy tax credit seats. The other 3 were low-income housing, new markets, or state incentives. We map 480 lawyers whose recent work is this specialism. That 480 is our mapped book, inside a firm market map of 1,480,000+ lawyers. Firm-wide in-house placements since 2017 stand at 230+.

02 Who hires

Eight buyers. Different opinions.

The same resume word, tax credits, covers seats that do not interview the same way. The brief names the credit, the document, and the buyer.

1. Law-firm tax groups

Firms hire lateral partners and senior associates to sign begin-construction opinions, transfer opinions, and tax-equity partnership agreements. The group sometimes sits in tax and sometimes shares the file with project finance. A partner search here fails when the book is general M&A tax with one credit memo attached. We ask which opinions the lawyer signed, and whether the firm’s conflicts clear the sponsors and the buyers already on the platform. Firm mandates are 7 of the 11 since 2023. Partner moves run through partner recruiting. Associate and counsel moves run through associate recruiting.

2. Independent power producers and developers

The in-house seat registers the project, chooses the credit, and signs the transfer or the tax-equity partnership. In 2025 a NYSE-listed independent power producer in Houston hired tax counsel for credit transfers. The shortlist was out in 17 days. The accepted offer was in week 12. The general counsel of that company told us: The shortlist was people who had closed a transfer, not people who had read the regulations. Developer and IPP hiring concentrates in markets such as Houston tax. Company searches use in-house counsel recruiting.

3. Tax-equity investors, infrastructure funds, and lenders

Transferability did not retire the partnership flip. Funds and banks still hire counsel who can hold a flip and a purchase of credits in the same financing. Treasury Decision 9993 states special rules for partnerships and S corporations, which is the document those seats live in. The infrastructure version of this hire is described on infrastructure and project finance and on renewables and clean energy.

4. Corporate tax departments that buy credits

A buyer’s counsel diligences recapture and excessive credit transfer. Both are in the July 1, 2024 final regulations. The seat often reports to the head of tax inside finance, which is a different pay desk from a lawyer who reports to the general counsel. We separate those reporting lines before we price the search.

5. Manufacturers

The advanced manufacturing production credit under section 45X is its own file: domestic content, related-party sales, and a transfer election. Public Law 119-21, section 70514, is the phase-out and restriction of that credit. The same statute, section 70511, terminates the clean hydrogen production credit. A manufacturing search asks for a closed 45X transaction, and it treats a general corporate tax practice as a different hire. Section titles: Public Law 119-21.

6. Low-income housing syndicators, developers, and investors

Section 42 counsel allocates, syndicates, and defends the housing credit. For calendar year 2026, IRS Notice 2026-22, citing section 4.08 of Rev. Proc. 2025-32, sets the population component of the state ceiling at the greater of $3.416 multiplied by state population, or $3,953,600. Population figures in that notice are the Census estimates released January 27, 2026. Source: Internal Revenue Bulletin 2026-15.

7. Community development entities

New markets counsel represents CDEs, investors, and borrowers on section 45D. A Federal Register notice dated September 15, 2026 says that, under Public Law 119-21, the CDFI Fund expects to allocate $5 billion of new markets tax credit authority for the calendar year 2026 round, and anticipates up to $100 million of investment authority per allocatee. Source: Federal Register, September 15, 2026.

8. State and local incentive counsel

Film, data-center, jobs, and similar state credits are a separate statute from the federal energy clock. They show up in city tax markets where the incentive is local. Atlanta tax is one of those markets. Washington tax is where federal credit policy and IRS practice concentrate. 3 of our 11 searches since 2023 were housing, new markets, or state incentives, and the other 8 were energy.

03 The statute clock

Dates a credits lawyer is hired against.

Wind and solar are on a construction deadline. Housing credits, new markets, and several consumer incentives are on different dates. Mixing them is how a search brief goes wrong.

Sections 45Y and 48E were added by sections 13701(a) and 13702(a) of Public Law 117-169. They apply to qualified facilities placed in service after December 31, 2024. Treasury and the IRS published final regulations under those sections on January 15, 2025 (90 FR 4006). Revenue Procedure 2025-14 lists wind and solar at a greenhouse-gas emissions rate not greater than zero. All of that is restated in IRS Notice 2025-42.

Public Law 119-21, 139 Stat. 72 (July 4, 2025), then cut the wind and solar runway. Sections 70512 and 70513 terminate the 45Y and 48E credits for an applicable wind facility or applicable solar facility placed in service after December 31, 2027, where construction begins after July 4, 2026. Notice 2025-42, published in Internal Revenue Bulletin 2025-36 (September 2, 2025), and written to follow Executive Order 14315 (July 7, 2025), tells a taxpayer how to show that construction began in time. For facilities whose construction had not begun before September 2, 2025, the Physical Work Test is the method, and the taxpayer must keep a continuous program of construction. Section 6 of the notice keeps a five-percent safe harbor only for a low-output solar facility with maximum net output of not more than 1.5 megawatts, measured in alternating current. Output of facilities with integrated operations is aggregated. Storage technology is carved out of the wind and solar termination in the notice’s own definitions.

Consumer and building incentives moved on a faster calendar. IRS fact sheet FS-2025-05 (August 21, 2025) prints these termination dates. The fact sheet says the FAQs are not published in the Internal Revenue Bulletin, and that the statute controls if an FAQ is wrong. The dates it prints:

  • Section 25C, energy efficient home improvement: no credit for property placed in service after December 31, 2025.
  • Section 25D, residential clean energy: no credit for expenditures made after December 31, 2025. Installation completed after that date does not qualify, even if the taxpayer paid earlier.
  • Sections 25E, 30D, and 45W, clean vehicles: no credit for a vehicle acquired after September 30, 2025. Acquired means a written binding contract and a payment. The credit is still claimed when the vehicle is placed in service.
  • Section 30C, refueling property: no credit for property placed in service after June 30, 2026.
  • Section 45L, new energy efficient home: no credit for a home acquired after June 30, 2026.
  • Section 179D, energy efficient commercial buildings deduction: no deduction for property whose construction begins after June 30, 2026.

Source: IRS, FS-2025-05, August 21, 2025. A search for “energy tax credit lawyer” that does not say which of these dates the client is hiring against will interview the wrong bench. Begin-construction opinions for utility-scale wind and solar are a 2026 file with a July 4, 2026 gate and a December 31, 2027 placed-in-service gate. Residential 25D work ended with 2025 expenditures. Housing-credit allocation under the 2026 ceiling, and the $5 billion new markets round, continue on their own calendars.

The hiring consequence is specific. Through the July 4, 2026 gate, sponsors and firms need lawyers who can document physical work and continuity, and who can tell a 1.5 megawatt solar project from one that has lost the five-percent safe harbor. After that gate, the same lawyers are hired for credits already transferred, for recapture and excessive-credit disputes under the July 1, 2024 regulations, and for technologies the wind-and-solar termination does not cover. We scope the mandate to one of those files before we map names.

04 Compensation

Three pay desks.

Name the desk first. The salary page for that desk is the pay figure, and the offer uses that published scale.

No statistical agency publishes a 2026 median salary for an energy tax credit lawyer. Pricing this seat off a single national lawyer average mixes three desks that do not pay the same way.

Lockstep firm associates are paid on the matching scale for their class year. In-house lawyers who report to a general counsel are paid on a legal-department scale. Tax lawyers who report to a CFO or a head of tax are paid on a finance scale. IRS Chief Counsel is General Schedule pay. Those three comparisons, with their sources, are on the tax attorney salary 2026 page. The class-year scale is on the BigLaw associate salary scale. Company-side bands that are not tax-specific are on in-house counsel salary 2026.

What changes the offer, inside whichever desk the seat sits on, is the file. A counsel who has registered a project, signed a transfer, and lived through recapture diligence is a different candidate from a tax generalist who has read section 6418. We put that distinction in the brief, and the offer uses the published scale for that desk.

The search itself is retained only. The fee is 25–30% of the hire’s first-year total compensation. The retainer is 30% of the fee, paid at engagement and kept if the client cancels. A company that wants to scope the seat before that letter is signed can start at a conversation or at contact.

05 The search

Eleven searches since 2023. One Houston hire.

These figures are the specialism book since 2023. Firm-wide in-house placements since 2017 are a separate count: 230+.

Since 2023 Sartori & Partners has run 11 tax-credit and incentives searches: 7 law-firm and 4 company-side. 8 were energy tax credit seats. 3 were housing, new markets, or state incentives. The median time to shortlist was 19 days. The median time to an accepted offer was 12 weeks. 9 of the 11 offers were accepted.

One of the company searches is the 2025 Houston matter. A NYSE-listed independent power producer hired tax counsel to run credit-transfer work. Shortlist on day 17. Accepted offer in week 12. That week matches the 12-week median for the 11. The day-17 shortlist is inside the 19-day median. The general counsel said: The shortlist was people who had closed a transfer, not people who had read the regulations.

The mapped field for the specialism is 480 lawyers: energy transfers and tax equity, housing credits, new markets, and state incentives. Outreach is to that list, in private, and only after conflicts are checked. A name leaves us only with the candidate’s written consent. The parent practice is tax recruitment. Planning and controversy, which is a different opinion from a transfer opinion, is tax planning and controversy.

On a live mandate we read four documents before a name goes in the pool. The begin-construction file, when the credit depends on work started by July 4, 2026. The IRS registration. The transfer agreement or the tax-equity partnership agreement, including who bears recapture. And, for solar, whether integrated operations push aggregated output above 1.5 megawatts and take the five-percent safe harbor in Notice 2025-42 off the table. The shortlist is lawyers who can walk through those four, including when the resume already says energy tax.

Tax credits and incentives recruitment — common questions

What does an energy tax credit lawyer recruiter fill?

What did Public Law 119-21 change for wind and solar credits?

Public Law 119-21, 139 Stat. 72, was signed on July 4, 2025. Sections 70512 and 70513 end the section 45Y and 48E credits for an applicable wind or solar facility placed in service after December 31, 2027 if construction begins after July 4, 2026. IRS Notice 2025-42, in Internal Revenue Bulletin 2025-36 (September 2, 2025), makes the Physical Work Test the method for that deadline, with a five-percent safe harbor kept only for low-output solar of not more than 1.5 megawatts AC. The notice applies to facilities whose construction had not begun before September 2, 2025.

Who hires tax credits and incentives lawyers?

Eight buyer types hire this counsel: law-firm tax groups; independent power producers and developers; tax-equity investors, infrastructure funds, and lenders; corporate tax departments that buy credits; manufacturers on the section 45X credit; low-income housing syndicators and investors; community development entities using the new markets credit; and companies claiming state film, data-center, or jobs incentives. Since 2023, 7 of Sartori & Partners’ 11 searches in this specialism were for law firms and 4 were for companies. 8 of the 11 were energy tax credit seats.

How is tax credits and incentives counsel paid?

No agency publishes a 2026 median for energy tax credit counsel. Firm cash, in-house legal pay, and IRS Chief Counsel General Schedule pay are three different desks, set out on the 2026 tax attorney salary page, the associate salary scale, and the in-house counsel salary page. A credits seat is priced off the desk it sits on, plus the opinions the lawyer has actually signed.

How long does a tax-credit search take?

Across 11 tax-credit and incentives searches since 2023, the median shortlist was 19 days and the median accepted offer was 12 weeks. 9 of the 11 offers were accepted. In 2025 a NYSE-listed independent power producer in Houston hired tax counsel for credit transfers: shortlist on day 17, accepted offer in week 12. Every search is retained. The fee is 25–30% of first-year total compensation, and the retainer is 30% of the fee.
