Complication
A works council was constituted three weeks into the search, adding a §99 BetrVG consent step nobody had priced, and 2 shortlisted candidates would have lost their Versorgungswerk exemption because the proposed activity description did not meet the §46 BRAO independence tests.
Outcome
Activity description rewritten with counsel so the Syndikus admission survived, hire made at €135,000 base plus a 25% bonus and a phantom-equity grant, and the first follow-on hire filled 5 months later.
Fund and product counsel for a Frankfurt asset manager

In-house mandate archetypes in Frankfurt, by seniority and band
Our Frankfurt mandate telemetry records 17 closed in-house searches over the trailing three years, in four shapes. Regulatory and supervisory counsel inside directly supervised banks account for 6, usually 6 to 12 years post-qualification and reporting two levels below the group general counsel. First legal hires and department builds for private-equity-backed Rhine-Main platforms account for 4, normally 8 to 14 years qualified with budget authority for 1 to 3 further hires in year one. Scope is drawn tightly in all four: §46c BRAO bars a Syndikusrechtsanwalt from defending the employer or its staff in criminal and fine proceedings, and the European Commission restated in November 2025 that Germany does not extend legal professional privilege to in-house lawyers in competition investigations.
Two of our own numbers do not flatter us. Of those 17 closed searches, 3 ran past the 16-week band, and 2 further processes were abandoned by the employer after the works council step pushed the start past the budget year. In the 9 searches that ran inside directly supervised institutions the median gap between signature and effective start was 4.5 months, against 2 months elsewhere.
